The challenge is piecing together the events as seen through the eyes of a dozen witnesses. ========================== WITHOUT A TRACE 1X03: HE SAW, SHE SAW ========================== COLD OPEN: [EXT. NEW YORK SUBURBIA (STOCK) - DAY] [EXT. NEW YORK SHOPPING MALL -- PARKING GARAGE - (STOCK) - DAY] CUT TO: SCENE #01: [INT. SHOPPING MALL - GARAGE - DAY] (EMILY and DUNCAN MULLER walk to their car parked in the shopping mall garage after a day of shopping. They are both carrying shopping bags.) EMILY MULLER: Well, it was the first fancy party you had ever taken me to. I wanted my hair to look nice. DUNCAN MULLER: It looked more than nice. It was big. EMILY MULLER: You said I looked beautiful. DUNCAN MULLER: What can I say. I was young, in love and the rest of you looked beautiful. EMILY MULLER: You have never been a good liar. (DUNCAN MULLER suddenly stops.) DUNCAN MULLER: Oh! I left my credit card Bloomingdale's. EMILY MULLER: You did not. You just want to return those plaid boxer shorts I made you buy. DUNCAN MULLER: Yes, but I won't. (DUNCAN MULLER hands the shopping bags he's carrying to his wife.) EMILY MULLER: Okay. DUNCAN MULLER: I'll be right back. (DUNCAN MULLER gives EMILY a kiss on the cheek.) EMILY MULLER: I'll meet you at the car. DUNCAN MULLER: All right. (He turns and starts walking back to the mall. EMILY continues on to the car.) (DUNCAN MULLER makes his way back to the mall. In the background, a man yells.) MAN: Let her go. EMILY MULLER: No! (DUNCAN MULLER turns around when he hears the commotion and the car speeding off. He heads back to the parking stall which is now empty.) WOMAN: Oh, my god, he took the car. He took her, he took her car. DUNCAN MULLER: Emily? Emily?! (yells) Emily?! (He sees a man on the ground near the empty parking stall. EMILY'S shopping bags are scattered on the ground.) DUNCAN MULLER: Emily? (DUNCAN MULLER looks all around him for any sign of his wife.) DUNCAN MULLER: Emily? (DUNCAN MULLER runs for the stairs leading to the ground level and main street above. He runs one flight of stairs up just in time to see the back of his car driving off.) [EXT. SHOPPING MALL - GARAGE - DAY] (He stops in shock.) DISSOLVE TO: LEGEND: 1 HOUR MISSING SCENE #02: [INT. SHOPPING MALL - GARAGE - DAY] (Down in the parking garage, the area is cordoned off with police tape. JACK confers with SAMANTHA while VIVIAN stands nearby.) SAMANTHA: Emily Muller, 36. Lives in Harbor City with her husband. He didn't see anything. But four other witnesses say a male assailant forced her into the car and drove away. (MARTIN and DANNY join the group.) MARTIN: Got an APB out on the car and the plate -- a Silver BMW X-5. DANNY: Nice car. JACK: Fast. MARTIN: Very. If he's topping it out they could be a hundred miles from here. DANNY: Fast car, you want a fast road. Odds are, head straight for the thruway. SAMANTHA: Choppers are on it. We set up a concentric search flaring inward from Exit 13 West and Exit 26 East. (While listening, JACK pulls out a pen, leans over and lifts up the handle of the bag to check out the shopping bags on the ground. VIVIAN: Media's got it already which will help. JACK: Anything else? SAMANTHA: She's got a cell phone. Hopefully it's with her and it's on. 9-X is tracking it for us. Also, her husband said she has an e-zpass for tolls. JACK MALONE: A couple dish towels, three pairs of boxers and a blouse. Just another day at the mall. (JACK turns and looks around.) CUT TO: WHITEBOARD TIMELINE: CLOSE UP OF PHOTOGRAPH: 7A-NY 108391 "EMILY MULLER" (Camera moves in for an extreme close up of the young woman.) HARD CUT TO END OF TEASER. ROLL TITLE CREDITS (COMMERCIAL SET) FADE IN. SCENE #03: [INT. SHOPPING MALL - GARAGE - DAY] LEGEND: 1.5 HOURS MISSING (Camera crews set up their equipment in the parking garage. JACK interviews DUNCAN MILLER, the missing woman's husband.) JACK: Did you get a look at the assailant? DUNCAN MULLER: Uh, by the time I'd turned around they were out of the parking lot. JACK: When you were inside the mall, did anything seem strange? Did you notice anyone out of the ordinary? DUNCAN MULLER: (shakes his head) No. Not at all. You know, we were just ... running errands. She didn't ... she didn't do anything. Now how could this happen? (Behind them, SAMANTHA walks by on her cell phone. The camera leaves JACK and follows SAMANTHA for a moment.) SAMANTHA: (b.g. on the phone) ... they're in her silver BMW ... (The camera continues and rests on MARTIN interviewing BRAD DUNSMORE, a reluctant hero wearing a blue baseball cap and sitting in the back of an Ambulance being treated for his injuries. He holds an ice pack to his left eye where the kidnapper hit him.) BRAD DUNSMORE: I'd been shopping in the mall for about an hour. I started to walk into the parking lot and I heard a scream. (Quick flashback to the parked car in the stall. EMILY MULLER screams. She's forced into the parked car.) BRAD DUNSMORE: (v.o.) They were struggling. He had her by the arm and I just started running ... (From one parking lane over, the camera rushes forward indicating that BRAD DUNSMORE is running toward the parked car. He passes by a homeless woman pushing a shopping cart.) BRAD DUNSMORE: Let her go! (BRAD DUNSMORE reaches the vehicle. He runs around the semi-closed driver's side door. The male kidnapper (who isn't wearing a cap on his head) turns around ...) BRAD DUNSMORE: (v.o.) By the time I got through ... (... and swings. He connects. Flash to white. End of flashback. Resume to present.) MARTIN: And you didn't get a good look at him? BRAD DUNSMORE: (shakes his head) No. No, I'm sorry. CUT TO: SCENE #04: [INT. SHOPPING MALL - GARAGE - DAY -- CONTINUOUS] (VIVIAN takes the statement of an OLD MAN wearing a sage-colored cap.) OLD MAN: I was trying to get it closed but this thing sticks all the time. (he indicates his car back door) That's when I heard her hollering. (The OLD MAN turns around to look at the parking stall. As he remembers, we hear a woman scream ... ) (Quick flashback to the parked car in the stall. A woman screams. The male kidnapper, who is wearing a green jacket and blue baseball cap, pushes EMILY MULLER into the vehicle. He pushes her inside and turns around.) BRAD DUNSMORE: Let her go! (BRAD DUNSMORE, who isn't wearing a cap, reaches the driver's door. The kidnapper throws his punch. It connects. BRAD DUNSMORE falls to the ground. The homeless woman pushes her shopping car across the vehicle's path. The kidnapper gets into the vehicle, closes the door and drives away.) (Flash to white. End of flashback. Resume to present.) (VIVIAN accompanies the OLD MAN to the yellow police tape. VIVIAN: Green coat wearing a baseball cap? OLD MAN: Yeah. VIVIAN: Are you sure? OLD MAN: Yes, ma'am. VIVIAN: Because the guy that you're describing sounds a lot like that guy over there. (VIVIAN points to BRAD DUNSMORE who sits in the back of the Ambulance. He is indeed wearing a green jacket and a blue baseball cap.) OLD MAN: I don't know how I got mixed up. CUT TO: SCENE #05 [INT. SHOPPING MALL - GARAGE - DAY -- CONTINUOUS] (DANNY is interviewing a WOMAN.) DANNY: Do you remember anything else? Anything? You never know what could help. WOMAN: I know Emily a little. So I can't be sure ... but for a moment when she first turned around, I thought she knew him. DANNY: The assailant? WOMAN: mm-hmmm ... (The WOMAN turns to the parking stall as she remembers ...) (Quick flashback to EMILY MULLER materializing and walking toward her parked car. She unlocks the driver's side door and puts her bags into the car. A man walks up to her from behind. EMILY turns around and gasps.) (End of flashback. Resume to present.) DANNY: That's when she screamed? WOMAN: (shakes her head) Um, no. It wasn't until he was pushing her into the car. CUT TO: [EXT. NEW YORK CITY (STOCK) - DAY] [EXT. FEDERAL BUILDING - DAY] (JACK and SAMANTHA walk past the following sign and into the building: JACOB K. JAVITS / FEDERAL BUILDING / 26 FEDERAL PLAZA.) CUT TO: SCENE #06: [INT. FBI - MISSING PERSONS UNIT - MAIN OFFICE -- DAY] LEGEND: 3 HOURS MISSING (Camera opens on the WHITEBOARD TIMELINE. VIVIAN is in front of the WHITEBOARD adding information to it.) (JACK and DANNY walk into the office and head toward the conference table.) JACK: Stay in contact with the news stations. Try and get some break-ins. We need a lead in at 5:00. (MARTIN stands up and joins them. He's holding two file folders which he then hands one each to JACK and DANNY.) MARTIN: So I've got three composites on our suspect. (DANNY opens the file folder and takes out the composite drawings of the kidnapper. SAMANTHA stands next to DANNY to look at the pictures.) SAMANTHA: White, maybe not white. Brown-haired or balding. Bearded man with a mustache. DANNY: You got to love eyewitnesses. Me, I'll take an old-fashioned grainy security video any day of the week. MARTIN: There's one witness unaccounted for -- the homeless lady crossing the parking lot with the cart. JACK: She's missing, too? MARTIN: Apparently, she took off after the carjacking. Guess she was freaked. JACK: Talk to me about the witness who knew the victim. DANNY: Well, she said Emily recognized the assailant. SAMANTHA: Maybe recognized. And he probably just charmed that out of her. JACK: Well, the wife goes missing the husband's the last one to see her. We don't need to talk about those percentages, do we? VIVIAN: (chuckles) I love the way your brain works. Always goes to the darkside. (VIVIAN joins the rest of the group at the conference table.) JACK: Well, the husband mysteriously walks off at just the right moment, somebody nabs the wife -- somebody she recognizes. Suspicious, wouldn't you say? (MARTIN silently nods his head.) SAMANTHA: Yeah, if there's a motive. JACK: Well, let's go and find one. CUT TO: WHITEBOARD TIMELINE: 9 A.M. -- HAIRCUT AT HOME 10-11 A.M. - SHOPPING AT MALL SCENE #07: [INT. FBI - MISSING PERSONS UNIT -- DAY] (VIVIAN and DANNY interview EMILY MULLER'S beautician who is standing behind her chair.) VIVIAN: Besides her husband you were the last one to see her. Did you usually go to her house for appointments? BEAUTICIAN: She called me early and asked if I could come by on my way to work. I do that sometimes to make a little extra money. DANNY: How'd she seem to you? BEAUTICIAN: Good. Actually, better than she had in a long time. (she sits down) She seemed really happy. (Quick flashback to day of the haircut appointment at The Muller's Residence. EMILY MULLER sits down in front of the mirror. She's relaxed and smiling.) BEAUTICIAN: Now, are you sure about this? EMILY: Very. I've been trying to get you to do this forever. BEAUTICIAN: What's the occasion? (The BEAUTICIAN puts the plastic jacket on EMILY. She moves to stand in front of EMILY, facing her.) EMILY: It's ... just time for a change. BEAUTICIAN: Yeah? Okay, so ... above the shoulder, a couple highlights. EMILY: Oh, above the shoulder's great. Let's hold off on the highlights. BEAUTICIAN: Come on ... EMILY: No. One thing at a time. (The BEAUTICIAN smiles, grabs her scissors and moves to stand behind EMILY, looking at her in the mirror. EMILY smiles and sighs.) [CLOSED-CAPTIONED: BEAUTICIAN: You ready?] [CLOSED-CAPTIONED: EMILY: I'm ready.] (Flash to white. End of flashback. Resume to present.) VIVIAN: This morning ... BEAUTICIAN: Well, she really wanted me to finish before Duncan got back from the gym. I sort of assumed she was doing it for him. DANNY: Did Duncan have a preference for short hair? (VIVIAN looks up from her notebook, sending DANNY a look at the strangeness of his question. DANNY looks back at VIVIAN.) BEAUTICIAN: (smiles) I think she wanted to do something new. You know, give him a change. They had a rough go of it. VIVIAN: How so? (For a moment, The BEAUTICIAN pauses, confused.) BEAUTICIAN: (shakes her head) Duncan didn't mention it? (She looks from VIVIAN to DANNY, both of whom have no idea what she's alluding to.) BEAUTICIAN: Oh. Well, I guess he doesn't like to talk about it. They lost a daughter. Celia. (both VIVIAN and DANNY react to this new information) Must be almost two years. VIVIAN: How? BEAUTICIAN: Leukemia. That poor thing-- she was sick most of her little life. VIVIAN: That must have been tough on their marriage. BEAUTICIAN: It was, but they stuck together. VIVIAN: And that morning when Duncan got back, how did they seem? BEAUTICIAN: See, that's what's so hard. They seemed really happy. For the first time in so long, she seemed happy. (VIVIAN and DANNY nod.) CUT TO: [EXT. INDUSTRIAL AREA (STOCK) - DAY] LEGEND: 5 HOURS MISSING SCENE #08: MULLER & MURPHY INVESTMENT REALTY [INT. MULLER & MURPHY - OFFICE - DAY] (Inside DUNCAN MULLER'S office, he's meeting with JEFF BLYE, his lawyer. Both are sitting down and whispering softly to each other.) (JACK appears in the doorway. DUNCAN MULLER and JEFF BLYE aren't aware that he's there. SAMANTHA appears behind him.) (JACK knocks softly on the door frame to get the men's attention.) (JACK and SAMANTHA enter the office. DUNCAN MULLER and JEFF BLYE both stand as they approach the table.) DUNCAN MULLER: Do you have news? JACK: The police found your wife's car. DUNCAN MULLER: Where? JACK: It was on the shoulder of a thruway. DUNCAN MULLER: Why... why would a kidnapper abandon a car in the middle of nowhere? JACK: That's what we want to talk to you about. (JACK looks pointedly at JEFF BLYE. For a moment, JEFF BLYE looks back, then both he and DUNCAN catch the hint. JEFF BLYE turns to pick up his briefcase.) JEFF BLYE: I'm sorry. (He holds out his hand for JACK and SAMANTHA.) JACK: Agent Malone, FBI. This is Agent Spade. JEFF BLYE: Uh, Jeff Blye ... a business associate of Duncan's. (JEFF BLYE leaves the room.) JACK: (to DUNCAN) Please, sit down. (They all take a seat at the table.) DUNCAN MULLER: So, uh, you said that the kidnapper left the car. JACK: There may have been another car stashed near the thruway or maybe he had a partner. SAMANTHA: Nothing was taken. Her purse, cell phone, palm pilot were all still in the car. DUNCAN MULLER: Oh, so ... so now what? SAMANTHA: One of our witnesses thinks Emily may have recognized her assailant. DUNCAN MULLER: What does that mean? SAMANTHA: It means this may not have been random. Is there anyone you can think of who would have wanted to hurt you or your wife? DUNCAN MULLER: No. No. SAMANTHA: Did your wife seem distracted or agitated at all in the last few days? DUNCAN MULLER: Hmm ... no, no, not at all. SAMANTHA: How's everything in your marriage? DUNCAN MULLER: It's fine. We're fine. (SAMANTHA glances at JACK.) SAMANTHA: Mr. Muller, all we care about is getting your wife back. Anything you tell us would be kept confidential. DUNCAN MULLER: I mean there's nothing, really. I wish there were. (Camera holds on JACK, who remained quiet during the interview.) CUT TO: WHITEBOARD TIMELINE: 3:17 P.M. - CAR FOUND SCENE #09: [EXT. SIDEWALK - DAY] (SAMANTHA and JACK walk along the sidewalk toward their parked car.) SAMANTHA: His wife's abducted and he goes to the office? JACK: Yeah. And when we talked about the car you noticed how he went straight to kidnapping not carjacking. SAMANTHA: And he never asked if there was any sign of a struggle. JACK: And how about that business associate of his? Mr. Blye ... he seems a little nervous to me. SAMANTHA: Well, you can be very intimidating. (she glances at JACK) (beat) So, what? You think they arranged a kidnapping? What's the motive? JACK: Money ... another woman ... revenge ... SAMANTHA: Call me old-fashioned but when a marriage isn't working divorce is probably the answer. You want to put someone on him? JACK: Absolutely. (JACK and SAMANTHA reach the car. In the distance, the sound of someone unlocking their car alarm is heard. JACK looks up and sees DUNCAN MULLER unlocking and entering a car through the driver's side. JEFF BLYE joins him from the passenger side.) JACK: There's Frick and Frack now. SAMANTHA: Looks like we'll just have to do it ourselves. (JACK and SAMANTHA get into their car. DUNCAN MULLER'S car leaves the parking area and heads to the street. SAMANTHA follows.) CUT TO: SCENE #10: [EXT. POST OFFICE - PARKING LOT -- DAY] (DUNCAN MULLER turns into the Post Office parking lot.) (SAMANTHA and JACK follow. JACK is on his cell phone with MARTIN who is back at the office running a background check for him.) INTERCUT WITH: [INT. FBI - MISSING PERSON UNIT - OFFICE - DAY] MARTIN: (on phone) Here we go. Jeff Blye ... Attorney-at-law, Thompson and Blye. (Up ahead, DUNCAN MULLER parks the car in front of the Post Office.) JACK: What kind of lawyer? MARTIN: Estate planning. JACK: How's that situation with the homeless woman? MARTIN: Locals are all over it. Guess they're tough to find when they've got no address. JACK: Okay. (JACK hangs up. SAMANTHA stops the car.) SAMANTHA: Divorce lawyer? JACK: Estate planning. SAMANTHA: Think he's here to mail his will? (Though the question is flippant, it gets JACK to thinking. They watch as DUNCAN MULLER gets out of the car with a large cardboard box under his arm. He heads for the nearest Post Office Box.) JACK: (realizing) Damn it, that's a ransom. (JACK gets out of the car.) (DUNCAN MULLER mails the box. He seems surprised when he hears JACK'S voice behind him. He turns around and sees JACK and SAMANTHA approaching him.) JACK: (accusing) You got a ransom note, didn't you? What are they asking for? JEFF BLYE: You can't prevent my client from paying a ransom. You know that. (DUNCAN steps away from the mail box and heads back to his car. JACK persistently follows him. SAMANTHA walks past DUNCAN and heads inside the Post Office.) JACK: If you do this alone, you'll only create more danger for Emily. JEFF BLYE: Come on, Duncan, we've got to be going. JACK: At least tell us where you're sending the package. (DUNCAN reaches his car door ... ) JACK: Duncan ... (DUNCAN hesitates.) DUNCAN MULLER: (murmurs) I can't. (DUNCAN gets inside the car and closes the door. Camera holds on JACK as he watches.) FADE TO BLACK. (COMMERCIAL SET) FADE IN. [EXT. NEW YORK CITY (STOCK) - DAY] SCENE #11: [INT. FBI - MISSING PERSONS UNIT -- DAY] LEGEND: 19.5 HOURS MISSING (Camera opens on the WHITEBOARD TIMELINE. DANNY is just finishing adding information to the TIMELINE. He puts the pen down and turns back to the table where MARTIN is standing.) DANNY: I knew it. I knew it right from the beginning. This is not a carjacking. MARTIN: But if it was premeditated why do it in a crowded shopping mall? DANNY: They're trying to throw us off. MARTIN: You say "they." Does that include the husband? DANNY: Look, I feel bad for this guy that his daughter died but he's hiding something. I say we put him on the box. (DANNY closes the file and grabs the entire stack of files. He pasts MARTIN and heads out of the office. VIVIAN accompanies DANNY.) VIVIAN: He's lawyered up. No interview, no polygraph. DANNY: Maybe it's time we start digging through his dirty laundry. VIVIAN: Her sister just got back in town. Maybe she'll give us something. (DANNY and VIVIAN walk off camera.) CUT TO: SCENE #12: [INT. FBI - MISSING PERSONS UNIT -- DAY] (JACK and SAMANTHA interview EMILY'S SISTER. She's standing, arms crossed and upset by the recent developments.) EMILY'S SISTER: Can't you make him cooperate? I mean, isn't it illegal to pay ransom? JACK: No. And, unfortunately, he doesn't have to include us in any way. EMILY'S SISTER: But you're going to stay involved, right? SAMANTHA: Absolutely. JACK: Right. We're doing our best to try and figure out who may have taken your sister, but Duncan is making it very difficult for us. EMILY'S SISTER: Oh, god, he's stubborn. (JACK looks at her. She realizes what it must looks like and rushes to clarify it.) EMILY'S SISTER: I like Duncan. I feel terrible for him about everything. (she sits down) But he just always has to do things his own way. SAMANTHA: How would you describe their marriage? EMILY'S SISTER: Celia was sick for so long. That's what their life was about. And then when she died, I think that they didn't know how to be with each other or anyone else, for that matter. SAMANTHA: Is there anyone you can think of who would want to hurt them? EMILY'S SISTER: Well, there are a lot of unhappy people since spring hollow. JACK: Spring Hollow? What's that? EMILY'S SISTER: It's Duncan's big mall project. It's going under. There are a lot of people who lost a lot of money. Emily didn't even know about it ... (Quick flashback to EMILY and her SISTER talking in EMILY'S kitchen.) EMILY'S SISTER: (v.o.) ... until the day before she was taken. She was really upset. EMILY'S SISTER: (to EMILY) I'm sorry to be the one to tell you. I assumed you knew. (She stands and walks to the counter behind EMILY. She pours them both a drink of water from the pitcher on the counter.) EMILY MULLER: No, I did. I mean, I knew there were problems. I just ... what about your investment? EMILY'S SISTER: Don't worry about me. The good news about not having a lot to invest is you don't have a lot to lose. (EMILY'S SISTER grabs the glasses and hands one to EMILY.) EMILY MULLER: I just can't believe he wouldn't tell me. (EMILY takes the glass and puts it aside, upset by the news.) EMILY'S SISTER: What's going on between you two? EMILY MULLER: I don't know. EMILY'S SISTER: Is Duncan having an affair? EMILY MULLER: You know, I almost wish he was. 'Cause then at least I'd know he was actually alive. (EMILY'S SISTER pauses to think about it. She looks up at EMILY.) EMILY'S SISTER: Are you? (EMILY looks at her SISTER.) EMILY MULLER: Yeah. That's really my style. EMILY'S SISTER: I wouldn't judge you. I see what's happened. EMILY MULLER: I need to talk to him. (End of flashback. Resume to present.) EMILY'S SISTER: She stormed out of the house and headed over to his office. I called her that night and left a message, but she never called me back. CUT TO: SCENE #13: [INT. FBI - JACK'S OFFICE -- DAY] (JACK and SAMANTHA discuss the case.) JACK: Her sister says they were miserable. The hairdresser says there were happy. SAMANTHA: Sister, hairdresser -- almost equal levels of intimacy. JACK: There's a lot more than pain here. There's a lot of secrets in this marriage. SAMANTHA: Aren't their secrets in every marriage? (Without another word, SAMANTHA opens the door and leaves the office. Camera holds on JACK. He looks down.) CUT TO: SCENE #14: [INT. FBI - MISSING PERSONS UNIT - MAIN OFFICE - DAY -- CONTINUOUS] (SAMANTHA walks into the office and heads toward her desk. MARTIN, sitting at the conference table, sees her and catches her attention.) MARTIN: Hey, Samantha. SAMANTHA: (without stopping) Yeah? (MARTIN leans back and turns his head toward SAMANTHA.) MARTIN: Did Duncan Muller ever tell us why he took his wife to a fancy dinner the night before she was kidnapped? (SAMANTHA reaches her desk and goes through the file on the top of a stack of papers. She turns to look at MARTIN.) SAMANTHA: No, he never mentioned it. Why? MARTIN: (shakes his head) Well, I've been going over his personal credit card records. In the last six months this guy never dropped more than 84 bucks on a meal. That night, he drops $250 at the Augusta Grill. (SAMANTHA finds what she's looking for and walks toward MARTIN.) SAMANTHA: That's a lot of cheeseburgers. MARTIN: Yup. SAMANTHA: Especially for someone who's going bankrupt. MARTIN: Mm-hmm. (SAMANTHA leaves.) MARTIN: Thanks. (MARTIN grabs a piece of paper off of the conference table and also leaves.) CUT TO: WHITEBOARD TIMELINE: 8 P.M. - DUNCAN AND EMILY HAVE ROMANTIC DINNER (Camera holds on picture of Emily.) SCENE #15: [INT. AUGUSTA GRILL - DAY] (VIVIAN and DANNY interview the WAITER who is setting up the table.) VIVIAN: Did they come here often? WAITER: Maybe once before. Alex can check the book for you. DANNY: Was there anything out of the ordinary? WAITER: They brought their own wine. It was a pretty old cabernet, I think. Is that what you mean? VIVIAN: How did they seem to be getting along? (Quick flashback to the restaurant that night. The people currently in the restaurant disappear leaving the tables empty. The lights on the table light. People dressed for dinner appear sitting at the tables, waiters standing nearby.) WAITER: (v.o.) Great, I guess. (Camera pans over to the Muller's table where DUNCAN and EMILY appear.) WAITER: (v.o.) They talked all night. He held her hand. She got up to go to the ladies' room and I remember he stood up and he gave her a kiss. (Camera holds on EMILY laughing. End of flashback. Resume to present.) DANNY: Did you overhear any of their conversation? WAITER: Not really. The loudest thing to me was a 30% tip. (Off to the side, a phone rings.) WAITER: Sorry, excuse me a minute. (The WAITER leaves DANNY and VIVIAN.) DANNY: That dinner; emotional alibi. He was trying to establish the state of their happy marriage. And the big tip? Only guaranteed that the waiter would remember to give it to us. CUT TO: [LEGEND: 24 HOURS MISSING] SCENE #16: [INT. MULLER & MURPHY INVESTMENT REALTY -- OFFICE - DAY] (PETER MURPHY leads SAMANTHA and JACK into his office for his interview.) SAMANTHA: How long did you and Duncan work together? PETER MURPHY: We put together our first real estate project fifteen years ago. A strip mall in Hastings. Nine retail units and the best damn falafel north of Times Square. (PETER MURPHY indicates the seats at the table. SAMANTHA and PETER both sit. JACK continues to walk around the office looking at the things displayed. The mural on the wall reads: "Work is the Soul of Progress.") JACK: How about Emily? PETER MURPHY Well, sort of. Emily and I were set up on a blind date. That was nine years ago. I was pretty smitten. But we ended up running into Duncan. Of course, the rest is history. (JACK takes out his notebook and pen. He takes a seat.) JACK: And when's the last time that you saw Emily? PETER MURPHY: She was here the other day -- the day before what happened at the mall. She was looking for Duncan. I kind of got stuck running interference. [CLOSED-CAPTION (PETER MURPHY): I'd never seen her like this. Her and Duncan never had secrets.] (Quick flashback to the office. EMILY MULLER is pacing the office floor behind the table that PETER MURPHY sits.) PETER MURPHY: I don't want to be in the middle of this. You should really talk to Duncan. EMILY MULLER: Well, he's not here, so I'm asking you, Peter. PETER MURPHY: I'm not comfortable being put in the middle here. EMILY MULLER: I just don't understand. When did this start happening? PETER MURPHY: It's been happening, Emily. After the re-zoning, they hung us up over the E.I. statements. And then it was one thing ... EMILY MULLER: How bad is it? PETER MURPHY: Bad. (EMILY sits down. She takes a moment. When she speaks, PETER listens patiently.) EMILY MULLER: (quietly) Remember the Westcott Hotel? Duncan and I had dated about six months. He brought me up here to see the big foam model. He asked me what colors I would pick for the interior. I thought he was showing off ... wanted me to know what a big shot he was. But when I went to the opening of the hotel there they were -- all the colors I had suggested. PETER MURPHY: I always hated those colors. (PETER MURPHY smiles. EMILY chuckles. He reaches over and puts his hand on hers in comfort.) PETER MURPHY: (v.o.) She waited here for Duncan and they had it out. (End of flashback. Resume to present.) SAMANTHA: You heard the conversation? PETER MURPHY: No. But anyone could tell by their body language. SAMANTHA: Have you had any threatening letters, phone calls anything from angry investors? PETER MURPHY: Threatening, no. Angry ... (nods, yes.) SAMANTHA: We'd like a list of those names, please. PETER MURPHY: I'll have my secretary look into the phone logs. JACK: You have kidnap insurance, right? PETER MURPHY: Of course. It's included in the basic package for all investment companies. JACK: How extensive is it? PETER MURPHY: (shrugs) Just the basic coverage for reimbursement of ransom payments ... (JACK looks at PETER, who suddenly understands what JACK'S implying. He sighs.) PETER MURPHY: You can't think after all they've been through that Duncan could possibly do something like that. I doubt he even knew we had the coverage. JACK: I knew. CUT TO: SCENE #17: [EXT. SIDEWALK - DAY] (JACK and SAMANTHA walk down the sidewalk.) SAMANTHA: He's in love with her. JACK: Probably. SAMANTHA: Think Duncan knows? JACK: Probably. SAMANTHA: Maybe a safe place for her to land. He's familiar. He's got just as much to lose as she does. JACK: I don't know. She lost a child. If she was looking for an escape, she probably picked somebody that was completely separate from her real life. SAMANTHA: Is that from your infidelity handbook? JACK: Chapter three. SAMANTHA: Well, I hate to contradict the book, but if you're wrong, it leaves Duncan plenty of motive. (JACK and SAMANTHA walk out of camera frame.) CUT TO: [EXT. NEW YORK CITY (STOCK) - DAY] WHITEBOARD TIMELINE 4:30 P.M. - MURPHY CONFIRMS BUSINESS FAILURE SCENE #18: [INT. FBI - CONFERENCE ROOM DAY] (DUNCAN MULLER and JEFF BLYE sit in the conference room talking with each other. JACK and SAMANTHA enter the room. JEFF BLYE stands.) JEFF BLYE: Agent Malone, I would like it to be noted that my client is cooperating fully in this investigation. (JACK nods. He doesn't sit down.) JACK: (firmly) Apart from hiding every crucial piece of information your client has been very cooperative and we'll be sure to make a note of that. (JEFF BLYE nods.) JACK: Now, Mr. Muller ... (Both JACK and JEFF BLYE take their seats. SAMANTHA remains standing next to the door.) JACK: I would really like to believe that you have nothing to do with this. I really would. But you have to look at this from our perspective. You have a failing business and you have a kidnap policy. JEFF BLYE: (interjects) Wait a minute ... JACK: (ignores the interruption and continues) You and your wife are having problems yet the night before her abduction you were seen in public having a romantic dinner with her. And before she's taken, you turn and you go back into the mall. JEFF BLYE: (interrupts) All right. That's it. JACK: (ignores the interruption, his voice getting louder) You hide the ransom note from us. We have no idea what's in that package ... JEFF BLYE: (stands up) It's over. If you're saying my client ... (he continues to speak, but JACK continues to raise his voice above the lawyer's) JACK: (addresses JEFF BLYE) I'm saying that your client has been less than candid and has every reason ... (JACK rises from his seat) ... to stage a kidnapping to save his company! (The two men are now standing and shouting at each other. DUNCAN MULLER remains seated between the two men. He's getting agitated and upset by the meeting. Even SAMANTHA is alarmed as she rises.) (Finally ... ) DUNCAN MULLER: No! There is no way to save my company! The money that I sent them that's all that I had left. It was a loan against my retirement accounts. I was going to put it into Spring Hollow. Now, I do not care. I just want to get her back. (JACK immediately turns to DUNCAN MULLER and addresses him. He sits down across from the man.) JACK: If you want to get her back tell us everything that you know. DUNCAN MULLER: They told me I wasn't supposed to say anything. They said, they said they'd kill her. JACK: Duncan, they might kill her; but you can stop it, if you tell me the truth now. DUNCAN MULLER: (crying) You want the truth? (beat) Everything that me and Emily were about is buried in a three-foot grave. It's why every time I'd look at her all I could see was our pain. Until that day she came to my office, she faced me down and we had it out. And that night ... at that dinner ... I started to feel that, for the first time, we might have a second chance. Now she's gone again. SAMANTHA: (takes a step forward) She's not gone, Mr. Muller. And we want to bring her home but we need your help. DUNCAN MULLER: The, uh ... Jeff got the ransom call. Emily must have given them the numbers. (JEFF BLYE opens his briefcase.) JEFF BLYE: They asked for $100,000. This is where they told us to mail it. (He pulls out a sheet of paper and hands it to JACK. JACK reaches over, stands and grabs the paper. He looks at it.) JACK: (quietly) Thank you. (DUNCAN MULLER nods.) CUT TO: SCENE #19: [INT. POST OFFICE - DAY] LEGEND: 25 HOURS MISSING (MARTIN is interviewing the POST OFFICER MANAGER.) MARTIN: When would the package have been delivered? POST OFFICE MANAGER: If it was dropped off at Harbor City yesterday it would have been routed to White Plains and delivered here this morning. In the box by noon. (MARTIN glances at his watch.) MARTIN: It's 12:40. POST OFFICE MANAGER: "4203, 4203 ... " ah, here. (She points to the post office box. MARTIN peers in.) MARTIN: Great. Empty. (The POST OFFICE MANAGER looks it up.) POST OFFICE MANAGER: That box belongs to Ethel Robbins. CUT TO: SCENE #20: [EXT. ETHEL ROBBINS' RESIDENCE - DAY] (The door opens a slight crack and we see SAMANTHA SPADE'S FBI ID card.) SAMANTHA: Mrs. Robbins, I'm Samantha Spade ... (The door opens and an elderly woman walks out.) ETHEL ROBBINS: You're here about the box. Thank god. And so fast. I only called a few minutes ago. MARTIN: You called? (ETHEL ROBBINS leads MARTIN and SAMANTHA to the box.) EHTEL ROBBINS: Sure I did. As soon as I got home and saw that it didn't have my name on it. No name, just an address. Who sends a package like that? I thought "Turley Jenkins." She's always forgetting things. But she's on a cruise. That's why I figured it must be one of these unabombs ... SAMANTHA: (interrupting) Mrs. Robbins ... ETHEL ROBBINS: (continues) Why they picked me, I have no idea. (They arrive at her garage where the box is in the middle of the empty floor. ETHEL ROBBINS and SAMANTHA wait outside. MARTIN continues in to the garage and stands over the box.) SAMANTHA: Mrs. Robbins, we don't think anyone sent you a bomb. (His hands gloved, MARTIN picks up the box and proceeds to cut the box open.) ETHEL ROBBINS: You think that's such a good idea? Maybe I should wait in the yard or something. (she takes a step back) (MARTIN opens the box and pulls out a telephone book. He looks at SAMANTHA and turns the box over. Other than that, the box is empty.) FADE TO BLACK. (COMMERCIAL SET) FADE IN. [EXT. NEW YORK CITY (STOCK) - DAY] SCENE #21: [INT. FBI - MISSING PERSONS UNIT -- DAY] LEGEND: 27 HOURS MISSING (JACK is standing in front of the clear city street map. Camera pans over to the office entrance where DANNY, MARTIN and VIVIAN walk in. They head toward the conference table.) DANNY: But we got no connection between the old lady and the Mullers. VIVIAN: Yeah, but why would somebody take the money out and send the old lady an empty box? MARTIN: Maybe Duncan purposely put the money in. DANNY: Or maybe his lawyer took it out without Duncan knowing? VIVIAN: Or the kidnapper somehow got to it after the old lady picked it up. JACK: Or maybe they sent the empty package because they knew we'd be sitting around with eighteen different theories; that's the point. If the package never arrived then we'd be left with one theory -- that somebody nabbed it en route. DANNY: The post office. JACK: Or between post offices. MARTIN: Oh, that narrows it down to about a thousand disgruntled postal workers. JACK: If I'm right. (JACK reaches over where MARTIN hands him a sheet of paper.) MARTIN: Forensic says the package was covered in partials. No clean hits. (SAMANTHA joins the group. She remains standing while she reads from her notebook.) SAMANTHA: I got the E-Zpass info on Emily's car. In the last six months she's traveled up the thruway at least once each week and gotten off at exit nine. JACK: Tarrytown. DANNY: What's in Tarrytown? VIVIAN: Who's in Tarrytown? SAMANTHA: There's nothing in her palm pilot or credit card statements to explain the trips. VIVIAN: (without looking up) She's having an affair. SAMANTHA: Has to be. DANNY: I'll see if the business partner crosses with Tarrytown. (DANNY gathers his notebook and stands. MARTIN reads his telephone message out loud.) MARTIN: Hey, Westchester Sheriff found our homeless woman. She's back at the mall. (MARTIN grabs his files and stands also.) VIVIAN JOHNSON: It's been twenty-seven hours. I'm going to do a Jane Doe tap at the morgue. (VIVIAN grabs her things and stands.) JACK: That's a good idea. If our guy's got his money, he'll have no more need for Emily. SAMANTHA: And if he doesn't, he's panicking and hopefully he'll make a mistake. (SAMANTHA is seated at the conference table. JACK'S phone rings. He checks it, but doesn't answer it.) SAMANTHA: What was that about? JACK: (evasively) Nothing. Just, uh ... a little something at home. (SAMANTHA doesn't say anything.) JACK: Let's go to the post office. (JACK stands.) SAMANTHA: Sure. (SAMANTHA grabs her things and stands also.) CUT TO: [EXT. SHOPPING MALL GARAGE TOP VIEW (STOCK) - DAY] SCENE #22: [INT. SHOPPING MALL - GARAGE - DAY] (Close up of WILMA'S shopping cart. MARTIN is walking along side her getting her interview. She's pushing her shopping cart and holding a large ice cream cone in her other hand.) WILMA (HOMELESS WOMAN): Want a bite? It's got jimmies. MARTIN: (amused) Uh, no, I'm lactose intolerant, but thanks. So, you were saying? WILMA (HOMELESS WOMAN): Mmm, I was just pushing my cart, minding my own business and then all of a sudden, it was just crazy. CUE: (PRELAP) A WOMAN'S SCREAM (Quick flashback to the garage at the moment of the kidnapping. WILMA is pushing her shopping cart. BRAD DUNSMORE (the man with the baseball cap) runs into the cart, falls to the ground, gets back up and heads for the car.) BRAD DUNSMORE: Let her go! (He runs around the open car door where the kidnapper turns around and hits him. He falls to the ground. The kidnapper gets into the car, starts the engine and speeds off.) (End of flashback. Resume to present.) (WILMA is on the other side where she's turned in the direction that the speeding car took off in. MARTIN walks toward her.) MARTIN: So, he bumped into you. Are you sure? (WILMA lifts the ice cream cone as she continues to eat.) WILMA (HOMELESS WOMAN): Yeah. He gave us a pretty good dent but what are you going to say? I mean, he was trying to save that lady, right? MARTIN: (thoughtfully) I guess. CUT TO: SCENE #23: [INT. POST OFFICE -- DAY] (The Post Office Manager walks through the aisle carrying a file which she hands over to JACK. He takes it and looks through it.) POST OFFICE MANAGER: Here you go. All of my people, all of the shifts. If you told me a little more of what this is about, I could ... JACK: (interrupts) Thank you. This will be very helpful. (JACK walks away from the Post Office Manager.) CUT TO: SCENE #24: [INT. SHOPPING MALL - GARAGE - DAY] LEGEND: 28 HOURS MISSING (Back at the shopping mall garage, MARTIN is back at the kidnapping site. He's got a stack of orange cones that he's placing down on the parking spots according to the various eye-witness accounts. MARTIN puts an orange cone down where the vehicle was parked when EMILY was kidnapped.) (VIVIAN is on the phone waiting for MARTIN. She puts the phone down.) VIVIAN: Martin, why am I here? MARTIN: I have a hunch and I need your help proving it. (MARTIN heads back toward VIVIAN.) VIVIAN: And you thought you'd call me because if it didn't pan out I'd go easy on you? MARTIN: Exactly. (MARTIN puts all except two orange cones back into the shopping cart.) VIVIAN: Fine. (MARTIN puts one of the orange cones next to the shopping cart. He walks past VIVIAN and heads out toward the spot that BRAD DUNSMORE said he started from.) MARTIN: Okay, that cone over there is where Emily's car was. And right here is where Brad Dunsmore our good Samaritan, was standing. (MARTIN puts the final orange cone down. He turns around. He's ready to test his hunch.) (Flash to white. Quick flashback.) CUE: (PRELAP) WOMAN'S SCREAM (BRAD DUNSMORE turns around when he hears EMILY scream.) MARTIN: (v.o.) He told me he heard the scream, turned and ran straight at the assailant. (BRAD DUNSMORE starts to run toward EMILY. He runs past the woman with the shopping cart and goes straight to the car.) MARTIN: (v.o.) All the other witnesses said Brad grabbed the guy ... (End of flashback. Resume to present.) (MARTIN walks toward VIVIAN.) MARTIN: ... before he ever got in the car, right? VIVIAN: Yeah, and got a bloody nose for the effort. MARTIN: So, he hears a scream and, bam, off he goes. Now, by all accounts Emily struggled with her assailant for no longer than ten seconds at some point during which she screamed. That means, best case, Brad had ten seconds to get to her. So ... time me. (MARTIN pulls out a stop watch from his pocket and hands it to VIVIAN. He starts walking toward the spot where BRAD DUNSMORE started his run.) MARTIN: I'll start over here where Brad was. VIVIAN JOHNSON: You're not going to ask me to scream, are you? (MARTIN nods his head.) Scream. (VIVIAN starts the clock. MARTIN makes a mad dash to the car. When he reaches the final orange cone, VIVIAN stops the clock.) VIVIAN JOHNSON: Eight seconds. It's do-able. MARTIN: Yeah, that's what I thought. (MARTIN makes his way back to the starting point.) VIVIAN JOHNSON: So, what are you saying? Brad had a limp? MARTIN: No, it's better. (MARTIN grabs the shopping cart and pulls it into the pathway.) MARTIN: Our homeless lady had a very clear recollection of what happened yesterday. (Quick flashback of BRAD DUNSMORE crashing into the shopping cart.) MARTIN: (v.o.) According to Wilma, Brad tripped over her cart, stumbled, then got up ... (End of flashback. Resume to present.) MARTIN: ... and ran toward Emily's car. VIVIAN JOHNSON: So, you're saying he didn't get to the car. MARTIN: No, we know he did. Here's what I am saying. (MARTIN walks over to the starting point.) Will you time me again? (He sighs and waits for VIVIAN. He signals her to start.) VIVIAN JOHNSON: (beat) Go. (VIVIAN starts the clock. MARTIN runs through the same path. Only this time, he crashes into the shopping cart, stumbles, then resumes his run. He reaches the end. VIVIAN stops the clock, an impressed look on her face.) VIVIAN JOHNSON: Twelve seconds. (MARTIN heads back toward VIVIAN.) MARTIN: Brad never mentioned Wilma to me and if he did, bump into her cart like she told me he couldn't have made it to her car in time. She would have been out of the parking lot. VIVIAN: Unless ... unless he started running before Emily screamed. Which means he knew what was happening. He was part of it. MARTIN: (nods) Right. VIVIAN: You do a background check on this guy? MARTIN: It's on its way. VIVIAN: (smiling) Good. (VIVIAN hands the stop clock to MARTIN.) CUT TO: SCENE #25: [INT. POST OFFICE -- DAY] (The POST OFFICE MANAGER is once again talking with JACK.) POST OFFICE MANAGER: I'm getting the feeling you think it was one of my people who took that package. JACK: Just trying to be thorough, ma'am. (JACK'S cell phone rings. He answers it.) JACK: Yeah? INTERCUT WITH: [INT. SHOPPING MALL - GARAGE - DAY] MARTIN: Jack, it's Martin. I just got this: Brad Dunsmore, our good samaritan witness -- he works there at the Greendale Post Office. JACK: Okay, thanks. (JACK hangs up. He turns to the Post Office Manager.) Excuse me, ma'am. Did Brad Dunsmore have access to that package? (SAMANTHA stands nearby.) POST OFFICE MANAGER: Yes, but ... JACK: Where is he now? POST OFFICE MANAGER: He was in the back. Said he wasn't feeling good, though. Took off to go home. JACK: (to SAMANTHA) He's our guy. Let's go. (JACK and SAMANTHA leave. The POST OFFICE MANAGER watches.) CUT TO: SCENE #26: [INT. FBI - MISSING PERSONS UNIT -- DAY] (Meanwhile, back at the office, DANNY is on the phone.) DANNY: I need you to make sure the patrol cars stay out of the way. I don't want my suspect getting spooked. (beat) Yeah, two unmarked bureau cars should be there to pick up surveillance in six minutes. (beat) Yeah. CUT TO: [INT. FBI - MISSIN PERSONS UNIT -- HALLWAY INTO THE MAIN OFFICE - DAY] (MARTIN and VIVIAN walk in to the Main Office.) VIVIAN: I still don't know why he tried to stop it. MARTIN: Well, there was that one eyewitness who thought Emily knew her assailant. VIVIAN: What are you thinking? MARTIN: That it wasn't the assailant Emily recognized. It was Brad. VIVIAN: Then how do they know each other? MARTIN: I'm working on it. (MARTIN and VIVIAN reach DANNY, who is just finishing up his cell phone call.) DANNY: Copy that. (pause) Yeah, thanks. (pause) (DANNY hangs up.) Looks like our little good samaritan is on the run. MARTIN: Go get him. (DANNY runs out of the office. MARTIN and VIVIAN walk out of camera frame.) CUT TO: SCENE #27: [INT. MULLER RESIDENCE -- DAY] (JACK is interviewing DUNCAN MULLER.) JACK: We believe there were two people involved and that one of them may have got cold feet. DUNCAN MULLER: Oh, my god. JACK: Do you recognize him? (JACK hands DUNCAN MULLER a photo of BRAD DUNSMORE.) DUNCAN MULLER: This is the guy from the parking lot, right? I-I-I don't understand. I thought he tried to save her. (Off to the side, SAMANTHA finishes up her cell phone call.) SAMANTHA: (to the phone) All right, thanks. (to JACK) Jack? (JACK rises, leaving DUNCAN MULLER holding the photograph.) JACK: Excuse me. SAMANTHA: Suspect's on the move. Staties picked him up heading north toward Tarrytown. JACK: Emily and the good samaritan. SAMANTHA: You want to tell him? JACK: No. We've plenty of time for that later. (JACK and SAMANTHA look at DUNCAN.) CUT TO: SCENE #28: [EXT. TARRYTOWN RESIDENCE - DAY] LEGEND: 29.5 HOURS MISSING (Outside the cabin in Tarrytown, armed FBI agents surround the building. They systematically make their way closer to the cabin.) (Also approaching the cabin, their weapons drawn, are JACK, DANNY and SAMANTHA.) JACK: What's the situation? DANNY: He went in about 25 minutes ago. Audio picked up some activity at first, but it's dead now. SAMANTHA: Is he in there alone? DANNY: Unclear. JACK: Everybody in position. DANNY: If he climbs through the windows, they're all covered. JACK: Let's go! (The agent nearest the door smashes the door in.) [INT. TARRYTOWN RESIDENCE - DAY - CONTINUOUS] (BRAD DUNSMORE looks up, surprised by the intrusion. He watches as agents quickly rush into the cabin through the broken front door.) (He stands.) (SAMANTHA and JACK hold their weapons on him.) JACK: Down on the ground! Get down on the ground! Get down! Down! (BRAD DUNSMORE slowly lies face down on the floor, his hands raised above his head.) OFFICERS: We're all Clear! (JACK has an eye on DANNY as he checks out the other room.) JACK: (yelling to BRAD) Okay, where is she? Where is she?! BRAD DUNSMORE: I don't know! And she's not here. She's supposed to be here. (And with that, the officer grabs his hands behind his back preparing to cuff him.) HARD CUT TO BLACK. (COMMERCIAL SET) FADE IN. SCENE #29: [INT. TARRYTOWN HOUSE - DAY] LEGEND: 30 HOURS MISSING (DANNY is questioning BRAD DUNSMORE who is seated on the couch in front of him. Behind DANNY some distance away, JACK listens and watches as he leans against the counter against the far wall.) BRAD DUNSMORE: His name is Stan Watkins. We went to high school together. We planned to meet here after my shift today and split the money. DANNY: Why Emily? BRAD DUNSMORE: Stan was always coming up with these ideas. Get-rich-quick stuff, you know. One day he figured out this way for sending ransom through the mail. We thought it was brilliant. I'd just pick it up somewhere along the route. I'd seen Emily at the post office and ... we picked her because she was rich. DANNY: Was the plan always for you two to get involved? BRAD DUNSMORE: No. No. I was only supposed to follow her track her habits, that kind of thing. Then one day, we sort of bumped into each other. We started talking. A couple of days later, I decided to bump into her again. I asked if she wanted to have some coffee. (Quick flashback to BRAD DUNSMORE and EMILY MULLER walking. They stop at a bench near a brick wall. They're each holding a cup of coffee.) BRAD DUNSMORE: (v.o.) Truth is ... I never met anyone like her. She was beautiful and smart. She made me feel needed. (BRAD puts a hand on her shoulder. EMILY looks down. He reaches out and touches her chin in a mild caress. EMILY looks up at him.) (End of flashback. Resume to present.) BRAD DUNSMORE: I don't know what I was thinking. (SAMANTHA walks up to JACK.) SAMANTHA: (quiet voice) The sweep on his phone came in. The night before the abduction, he got a call from a pay phone at the Augusta Grill. JACK: (to BRAD) She called you that night. She ended the relationship, correct? (Quick flashback to EMILY on the phone at Augusta Grill.) EMILY MULLER: Brad, I'm sorry, I can't talk about it right now. BRAD DUNSMORE: Okay, that's fine. How about Thursday. EMILY MULLER: I can't. BRAD DUNSMORE: Is there something going on? (beat) Emily, are you okay? EMILY MULLER: I'm sorry. (pause) I can't do this anymore, Brad. BRAD DUNSMORE: Wait a minute. EMILY MULLER: I can't see you anymore. I'm ... sorry. BRAD DUNSMORE: Emily, wait, I don't get it. Where did all this come from? EMILY MULLER: I have to go. BRAD DUNSMORE: Emily, wait. Emily ... (EMILY hangs up the phone.) (BRAD is left with the phone near his ear. He hangs up his cell.) (End of flashback. Resume to present.) BRAD DUNSMORE: I'd been putting Stan off for months. I kept telling him the timing wasn't right. When she called I... guess I sort of lost it. JACK: You triggered the kidnapping? BRAD DUNSMORE: (nods) I followed her to the mall to make sure everything went okay. But when I saw her ... (shakes his head) ... I couldn't go through with it. JACK: Have you had any contact with Watkins since the parking lot? BRAD DUNSMORE: Yeah. He called a couple hours later. He was pretty pissed off. Told me if I didn't go through with things according to plan, he was going to hurt her. DANNY: Honor among thieves, right? JACK: Is there another cabin or remote place he might take her? BRAD DUNSMORE: (thinks for a moment, then shakes his head) I don't know. (The cell phone on the table starts ringing. BRAD picks it up and checks the caller ID. He recognizes the number, then quickly puts the cell phone on the table. He looks up at JACK.) BRAD DUNSMORE: It's him. It's Stan. JACK: Answer it. Tell him you've got the money. BRAD DUNSMORE: (shakes his head) I don't want to talk to him. (DANNY picks up the cell phone and holds it out to BRAD.) JACK: (firmer) Answer it, tell him you'll do whatever it takes to get him ... BRAD DUNSMORE: (yells) I'm not talking ... JACK: (shouts) Answer him! (BRAD takes the phone from DANNY. He answers it.) BRAD DUNSMORE: Yeah? Yeah, I've got it. Just tell me what you want. (pause) Hartsdale train station -- 5:00 A.M. Good. (pause) Look, Stan, don't hurt Emily, all right? Stan ... (BRAD slowly lowers the phone. He looks at JACK. Stan hung up.) JACK: Okay. We've got eleven hours. First break we've had all day. (JACK heads out of the room. DANNY stands. He grabs BRAD'S arm and hauls him to his feet.) DANNY: Come on. CUT TO: [EXT. NEW YORK CITY (STOCK) - NIGHT] SCENE #30: [INT. FBI - JACK'S OFFICE -- NIGHT] (JACK sits behind his desk, SAMANTHA stands next to him as he informs DUNCAN and EMILY'S SISTER of the latest plans. DUNCAN paces the floor in front of JACK'S desk.) JACK: I want Brad to make the exchange and he's agreed to do it. DUNCAN MULLER: He kidnapped my wife. SAMANTHA: They're friends. If we put one of our agents out there Watkins could panic and hurt Emily. DUNCAN MULLER: How do you know that he's not going to double-cross you? JACK: That's not going to happen. We need Brad to lure Watkins into the open so that we can apprehend him. DUNCAN MULLER: (shakes his head) No. No, it's my money. I'm not going to do it like that. EMILY'S SISTER: Duncan, please. This man could kill Emily. DUNCAN MULLER: I want to meet him. JACK: I don't think that's a good idea. DUNCAN MULLER: Well, how can I decide what to do if the only thing that I know about him is he was screwing my wife? (JACK sighs quietly.) CUT TO: SCENE #31: [INT. FBI -- INTERROGATION ROOM] (DUNCAN MULLER sits down across from BRAD DUNSMORE. Sitting off to the side against the wall is JACK observing the exchange.) DUNCAN MULLER: My name is Duncan Muller. Emily's my wife. (BRAD meets DUNCAN'S eyes and pauses a moment before answering.) BRAD DUNSMORE: I want to help you get her back. DUNCAN MULLER: Why should I believe that? You got her into this. (BRAD looks away.) BRAD DUNSMORE: I'm sorry. DUNCAN MULLER: Did she say why? BRAD DUNSMORE: Why? DUNCAN MULLER: Yeah. Yeah, why she was with you? BRAD DUNSMORE: She didn't talk about that. DUNCAN MULLER: (agitated) W-w-wait, was it because of Celia? I mean, did she say that? I mean, was it? JACK: (interrupting) Duncan, stop ... BRAD DUNSMORE: (shouting) I don't know! (beat) I don't even know who Celia is. (BRAD sighs.) DUNCAN MULLER: (upset) She's our daughter! BRAD DUNSMORE: I didn't even know you had a daughter. (That admission stuns DUNCAN.) DUNCAN MULLER: (quietly) All right ... just tell me something. Why do you want to do this? BRAD DUNSMORE: I don't really think you want me to answer that question. (BRAD doesn't look at DUNCAN.) BRAD DUNSMORE: I'll get her back. (DUNCAN looks at BRAD DUNSMORE. Without another word, he stands up and walks toward JACK. He pauses for a moment.) BRAD DUNSMORE: (softly) Let him do it. (DUNCAN leaves the room. JACK follows. He closes the door behind him. Camera holds on BRAD DUNSMORE.) CUT TO: SCENE #32: [EXT. HARTSDALE TRAIN STATION - NIGHT] LEGEND: 40.5 HOURS MISSING (BRAD DUNSMORE stands on the train platform carrying the bag of money. VIVIAN is also on the platform some distance away. She's holding two cups of coffee.) (Leaning against the building wall, JACK stands off to the side and watches over the scene.) (MARTIN is leaning against a lamp post, reading material in his hands.) (Cut back to JACK, who touches base with everyone on his mic.) JACK: Anything? (MARTIN checks in.) MARTIN: Nothing from One. (VIVIAN walks past MARTIN and checks in also.) VIVIAN: Nothing from Two. (DANNY, who is standing right behind BRAD DUNSMORE, also checks in.) DANNY: Watch Three reporting. Zip. (JACK continues to look around. He spots STAN WATKINS with EMILY MULLER walk onto the platform. He has a firm hold on her right arm. They both make their way toward BRAD DUNSMORE.) JACK: We got him. North end of the platform. (VIVIAN glances behind, turns around and starts walking in the same direction as she reports back in to JACK.) VIVIAN: Visual contact, moving along the platform. Blue jeans, brown jacket. Can't see if he's carrying. (STAN and EMILY continue to make their way toward BRAD. STAN has a gun pointed at EMILY.) JACK: (to mic) Martin, Danny, take an angle on them. Don't intercept. (STAN and EMILY continue to walk toward BRAD. As they near, MARTIN looks up from his paper and straightens from the lamp post he's leaning on.) JACK: (to mic) Vivian, cut off the back door. (STAN nervously looks around as they're almost upon BRAD.) JACK: Sam, now. (Everything happens quickly.) (On his cue, SAMANTHA promptly walks toward the tracks and throws something off the platform. It hits the ground and explodes with a bright flare of white light. Both STAN and EMILY are surprised. STAN turns around to see what's happening.) (In one smooth motion, SAMANTHA grabs EMILY and continues to push her in the direction she's walking, past BRAD and straight into the clear, her hold firm on the hostage.) (VIVIAN grabs BRAD DUNSMORE and pushes him to the side and out of the way while MARTIN and DANNY apprehend STAN WATKINS.) DANNY: FBI! Get down! Get on the ground! MARTIN: Get on the ground! FBI! DANNY: Get down! FBI! (DANNY grabs STAN WATKIN'S gun hand and proceeds to wrestle the gun away from him. MARTIN grabs STAN'S other arm. They both force STAN to his knees while they subdue him.) DANNY: Stay down! (STAN WATKINS falls to the ground, face down. MARTIN grabs both his hands behind his back. DANNY secures the suspect's weapon. SAMANTHA continues to escort EMILY MULLER down the platform.) (MARTIN has STAN WATKINS in his grasp. He glances up and notices that SAMANTHA and EMILY are in the clear. He reports back to JACK.) MARTIN: (to mic) Hostage secured. DANNY: (to mic) Suspect disarmed. (Off to the side, VIVIAN also handcuffs BRAD DUNSMORE.) (JACK intercepts SAMANTHA and EMILY where he then escorts them down the platform.) (Walking between JACK and SAMANTHA, EMILY MULLER turns around and looks behind her. BRAD DUNSMORE watches as EMILY walks off of the platform with the two agents. For a moment, their eyes meet.) (EMILY turns around, eyes forward and continues to walk off the platform.) (Camera holds on BRAD DUNSMORE.) CUT TO: [EXT. NEW YORK CITY (STOCK) - NIGHT] SCENE #33: [INT. FBI OFFICE - MISSING PERSONS UNIT - NIGHT] (EMILY MULLER, VIVIAN and SAMANTHA walk silently through the hallway. They reach JACK's OFFICE where DUNCAN MULLER sits in the seat in front of the desk waiting for her.) (He turns and sees EMILY. He stands. EMILY pauses by the doorway.) EMILY: I'm sorry. Duncan ... DUNCAN: No, Emily ... please... not now. EMILY MULLER: I was so lonely. I missed her so much. I missed you. (DUNCAN walks toward his wife.) DUNCAN MULLER: (quietly) Well, we'll talk about this at home, okay? (DUNCAN walks past EMILY out of the office. EMILY stands there for a moment not moving.) VIVIAN: (o.s.) We need to take your statement. Okay. (VIVIAN escorts EMILY MULLER to another room to take her statement.) (SAMANTHA walks into JACK'S office. JACK is still seated behind his desk.) [INT. FBI - JACK'S OFFICE - NIGHT - CONTINUOUS] (With her mind on the MULLER'S, SAMANTHA asks JACK.) SAMANTHA: So, what do you think their odds are? (JACK doesn't say anything. He seems preoccupied by something else and it shows.) SAMANTHA: (concerned) Are you all right? JACK: (confesses) Marie and I separated. (JACK pulls off his glasses and rubs his tired eyes.) SAMANTHA: When? JACK: Three months ago. SAMANATHA: Three months. JACK: (nods) Yeah. SAMANTHA: Well, I don't know what to say. JACK: Well, you know, we were trying to work it out, and, uh we're in kind of, uh ... limbo. (SAMANTHA nods her head. She looks at JACK. For a moment, they don't say anything, each with their own thoughts.) SAMANTHA: I'm going to go home. JACK: (nods) Okay. SAMANTHA: Good night. (SAMANTHA turns and walks out of JACK'S office.) JACK: Good night. (Camera holds on JACK.) FADE TO BLACK. ======================== THE END ======================== [Captioning sponsored by CBS and Warner Bros.
