He turns around to look at the asian woman lounging in his bed.) JOHN "BULL" CARVER: Not bad, huh? For an old man. ASIAN WOMAN: I don't know why you keep saying that, John. You're not old. JOHN "BULL" CARVER: Well, the army thinks I'm old. They're the ones who count. ASIAN WOMAN: Well, the army's crazy. JOHN "BULL" CARVER: Mmm ... (He chuckles and turns around to look at the mirror again.) CUT TO: SCENE #02: [INT. HOTEL BALLROOM -- NIGHT] (It's a retirement party for JOHN "BULL" CARVER. The banner behind the table reads: "Unity is Our Strength".) CONGRESSMAN WHITEHURST: Vietnam ... Desert Storm ... Afghanistan. 34 years of service to his country. I was 22 years old and fresh out of west point when they dropped me in Vietnam. And if not for you, Bull, many of the men who are here to help you celebrate tonight would not have made it out of those battlefields alive, myself among them. That is a tribute to your courage, your leadership that transcends military honors. You have our love and our undying loyalty. Welcome home soldier. (The audience applauds and rises to their feet. CONGRESSMAN WHITEHURTS turns and shakes JOHN "BULL" CARVER'S hand.) JOHN "BULL" CARVER: Thank you. Kind words, Congressman. CONGRESSMAN WHITEHURST: Every one of them's true. Congratulations. (He gives JOHN CARVER a brief hug.) CUT TO: SCENE #03: [INT. HOTEL -LOUNGE HALLWAY -- NIGHT] (JOHN "BULL" CARVER is in the telephone booth talking with someone on the phone.) JOHN "BULL" CARVER: (to phone) It's my first night as a civilian. Hold on. (MANNY AYBAR stands outside the telephone booth trying to get JOHN "BULL" CARVER'S attention.) MANNY AYBAR: Hey, I've been looking for you, Bull. Everything all right? JOHN "BULL" CARVER: Yeah, it's fine. I'm just finishing up here. Just give me a minute, okay? Aybar? Order me another drink. (JOHN CARVER closes the telephone booth door ... and vanishes.) CUT TO: SCENE #04: [INT. HOTEL - LOUNGE HALLWAY -- DAY] LEGEND: 30 HOURS MISSING (DANNY, VIVIAN, MARTIN and JACK walk through the hotel hallway.) JACK: (v.o.) ... Colonel "Bull" Carver. Drove down here to attend a retirement dinner in his honor. At some point in the evening, excused himself to make a phone call ... he disappeared. VIVIAN: Any idea who he was calling? JACK: No, I'm still working on it. VIVIAN: Who called it in? JACK: His daughter. Name was "Tess Balkin." Married, lives in Yonkers. He was supposed to go up there yesterday, spend some time with the family. He never showed. VIVIAN: What do we have from the army? JACK: They've turn it over to CID, but they're passing the buck. MARTIN: What's up with them not taking care of their own? JACK: Yeah, I know. 34 years in the service, already they've forgotten about him. (SAMANTHA exits the room behind them and call out to JACK.) SAMANTHA: Jack. There's something you need to see. (She heads back to the hotel room; JACK follows behind her.) CUT TO: SCENE #05: [INT. HOTEL ROOM -- DAY] (The hotel room door opens. JACK and SAMANTHA enter.) SAMANTHA: It's over here. (On the table is a row of medals, put there deliberately.) JACK: Distinguished service medal ... Bronze Star ... Purple Heart ... Silver Star ... Vietnam Service Medal ... Liberation of Kuwait. SAMANTHA: Are they in order of importance? JACK: Uh ... no. If they were, it would be Silver Star first, then Bronze Star. It appears that they're in chronological order. Maybe the timeline of his career. (She looks on the side and picks up the empty holster.) SAMANTHA: Well, then I think I know how his career ends. His service pistol's missing. CUT TO: WHITEBOARD TIMELINE: (Camera close up of JOHN "BULL" CARVER. Case No. 7A-NY ... ) HARD CUT TO END OF TEASER ROLL TITLE CREDITS (COMMERCIAL SET) FADE IN. [EXT. ATLANTIC CITY (STOCK) - DAY] LEGEND: 31 HOURS MISSING SCENE #06: [INT. HOTEL BALLROOM -- DAY] (DANNY and JACK interview MANNY AYBAR.) MANNY AYBAR: Figured he'd join us after he got off the phone. That's the last I saw of him. DANNY: Do you he any idea who he was talking to? MANNY AYBAR: 1:30 in the morning? Lady friend, maybe. Like I said, I hadn't seen the man in thirty years. I don't know a lot about his personal life. JACK: I understand that you were the one that organized the weekend. MANNY AYBAR: I called some of the fellas, and things sort of snowballed. JACK: How was Bull Saturday night? MANNY AYBAR: Like old times. Happy to see everybody. JACK: Any idea why he was retiring? MANNY AYBAR: Some incident in the Philippines. I don't know the whole story. But I know he was disappointed about the way the army treated him in the end. (SAMANTHA walks in and catches JACK'S attention.) SAMANTHA: Jack? JACK: (to MANNY AYBAR) Excuse me for a second. (JACK stands and meets SAMANTHA.) SAMANTHA: I did a quick rundown of the attendees at the banquet. Most are accounted for, except Congressman Whitehurst who left around 10:30 that night and a former platoon mate named Wallace Sykes, who checked out unexpectedly around 6:00 A.M. Yesterday morning. He drove back to South Carolina. JACK: Well, let's find out why he left so fast. SAMANTHA: Okay. (MARTIN joins them.) MARTIN: I just had a conversation with the bartender. He said that Bull Carver and one of his buddies got into a shoving match on Saturday night. CUT TO: SCENE #07: [INT. HOTEL ROOM -- DAY] (JACK and VIVIAN inter view PLESAC. JACK grabs two cups of coffee and sits down at the table.) JACK: I understand that you and Lieutenant Colonel Carver got into some kind of altercation that night. PLESAC: That was nothing. We had a couple of drinks, we lost our cool. It was nothing. (Quick flashback to: The four men sit at the bar that night.) MANNY AYBAR: So, how does it feel, Bull, to finally be a free man? JOHN "BULL" CARVER: It's a great unknown, Aybar. It's a great unknown. PLESAC: Well, what do you got to worry about? Coast on your big fat officer's pension. Be down in Florida hitting golf balls ... gee! MANNY AYBAR: How about another round, fellas? On me. WALLACE SYKES: Seven and seven, double shot. Whoo! PLESAC: Sykesie always doubles up! Especially when somebody else is picking up the check. Honest to god, Sykesie! Have you ever picked up a bar tab in your whole miserable life? JOHN "BULL" CARVER: Lay off, Plesac. PLESAC: Oh, lighten up, Bull. He knows I'm kidding. JOHN "BULL" CARVER: I said lay off. PLESAC: Who the hell are you to complain, anyway? You're the one who was always riding his mangy little ass. JOHN "BULL" CARVER: You know, Plesac, what I'm trying to figure out? How somebody like you made it back from the war when we lost all those other good men. PLESAC: Good men? Like who, Bull? Like ... Tommy Lewis? JOHN "BULL" CARVER: You son of a bitch. (JOHN "BULL" CARVER looses it and grabs PLESAC. AYBAR stands up and separates the two men.) PLESAC: Get your hands off me! MANNY AYBAR: Hey, hey! PLESAC: I'm not afraid of you, Bull ... MANNY AYBAR: That's enough! Damn it, Plesac! What you doing? PLESAC: All right, I'm all right! AYBAR: Move down. Move! (End of flashback. Resume to present.) VIVIAN: Who's Tommy Lewis? PLESAC: Staff Sergeant Tommy Lewis. He was killed at Kam Li. He was the best of them. JACK: And that was the end of the fight between you and Bull? There was nothing more? PLESAC: Look, I got drunk and stupid, and he put me back in my place. Which he should have. 20 minutes later, it was over. We're laughing, swapping stories. He was showing me pictures of his grandkids. It was like it never happened. I love that man. (beat) We all do. CUT TO: [EXT. ATLANTIC CITY BOARDWALK (STOCK) - DAY] SCENE #08: [INT. HOTEL -- DAY] (JACK interviews TESS BALKIN.) JACK: Thanks for coming in. TESS BALKIN: Course. God. The whole drive over here, all I could think about was the last time I saw my father. JACK: When was that? TESS BALKIN: I hadn't seen him in almost a year. And then, all of a sudden, he shows up at my office ... (Quick flashback to: JOHN "BULL" CARVER walks up to TESS BALKIN in a restaurant.) TESS BALKIN: (v.o.) ... while I'm having lunch. JOHN "BULL" CARVER: Tess? (TESS stands up.) TESS BALKIN: Dad. What are you doing here? JOHN "BULL" CARVER: That any way to greet your father? I stopped by your law firm. Your secretary said I could find you down here. (She gives him a hug.) TESS BALKIN: I-I didn't even know you were back in the country. JOHN "BULL" CARVER: I sent you the postcard from Manila. TESS BALKIN: I got that. Thank you. JOHN "BULL" CARVER: So, what's going on? TESS BALKIN: Uh, everything's fine. It's okay. Uh, have a seat? JOHN "BULL" CARVER: Thanks. (They both sit down. She smiles. He sighs.) TESS BALKIN: I'm not used to seeing you out of uniform. JOHN "BULL" CARVER: I'm retired, Tess, they forced me out. TESS BALKIN: I'm sorry. JOHN "BULL" CARVER: They were some good years. (she nods) I mean, they were some great years for me. TESS BALKIN: So ... what are you going to do now? JOHN "BULL" CARVER: Oh, I got some irons in the fire. Uh, the reason I wanted to talk to you is I think I want to rework my will. TESS BALKIN: Okay. JOHN "BULL" CARVER: You and the girls ... I want you to have everything. You can draw up the papers for that, right? TESS BALKIN: (shakes her head) Uh, not if I'm going to be the beneficiary, no. But I can have an associate do it for you. JOHN "BULL" CARVER: Great. I'd like to do that as soon as possible. TESS BALKIN: You're not sick, are you? (She leans in toward him.) JOHN "BULL" CARVER: (He chuckles) No, no. No, you kidding me? You ever known be to be sick for a day in my life? (pause) How are the girls? TESS BALKIN: They're good. Growing up. (TESS pulls out a piece of paper and starts writing down the information on it.) TESS BALKIN: So, um, give him a call tomorrow, and he can help you with whatever you need. JOHN "BULL" CARVER: Thanks. (End of flashback. Resume to present.) TESS BALKIN: I'd never seen him so ... vulnerable. And, uh ... I didn't reach out to him at all. And when he called from Atlantic City and said he'd like to come to church with the girls, I ... I doubt I sounded very enthusiastic. JACK: My father was in the army. I know how hard that life can be. TESS BALKIN: He ... didn't want you to follow in his footsteps? JACK: He did. But I guess it just didn't stick. TESS BALKIN: (chuckles) Well, it's not like you became a sculptor. JACK: No, not exactly. Um, did your father ever talk to you about his experiences in Vietnam? TESS BALKIN: No. JACK: Did he ever talk about a grudge between he and some of his buddies? TESS BALKIN: Honestly, I'd be the last to know. CUT TO: SCENE #09: [INT. HOTEL -- DAY] (DANNY is going through the security video on the computer. MARTIN walks in and watches.) MARTIN: What do you got? DANNY: Security video from the hotel casino next door. This is about ten hours before he went bye-bye. MARTIN: He's doing well. DANNY: Yeah, about 25 grand. MARTIN: Sure doesn't look like a guy who's on the verge of killing himself. DANNY: Unless it's one last blowout? Live for today, because tomorrow never comes. MARTIN: Yeah. We got to find that girl. DANNY: Yep. CUT TO: SCENE #10: [INT. HOTEL CONFERENCE ROOM -- DAY] (MARTIN and DANNY interview the ASIAN WOMAN) ASIAN WOMAN: I was supposed to be a present from the guys. They said he had a thing for Asian girls. MARTIN: Who made the arrangements? ASIAN WOMAN: Talk to the agency. I don't know. All he told me was, I was supposed to meet him at the hotel bar and then be available as long as he wanted me. DANNY: How were his spirits that night? ASIAN WOMAN: I gave him the whole subservient, sex kitten thing, and he was in heaven. (Quick flashback to: The ASIAN WOMAN and JOHN "BULL" CARVER are both in bed.) ASIAN WOMAN: So you've been in the army your whole life? JOHN "BULL" CARVER: Yeah, since I was 19. ASIAN WOMAN: You got drafted for the war? JOHN "BULL" CARVER: No, no, it was, uh ... I was at West Point. I didn't know much about Vietnam, but I couldn't wait to go and fight for my country. ASIAN WOMAN: mm-Hmmm ... A real cowboy. JOHN "BULL" CARVER: Yeah. Something like that. ASIAN WOMAN: So, cowboy, where's your wife? JOHN "BULL" CARVER: Well, she couldn't much take the life. You know, all the moving. ASIAN WOMAN: Well, it must be good to see your friends. JOHN "BULL" CARVER: Yeah. It's been a long time. ASIAN WOMAN: Hey. You okay? JOHN "BULL" CARVER: Yeah. (He sighs.) Just a lot of memories. I better get ready to go. ASIAN WOMAN: Okay. (End of flashback. Resume to present.) DANNY: The casino that he was playing at said he made a bundle that afternoon. ASIAN WOMAN: Didn't notice. MARTIN: That was a wad of cash in his pocket-- 25 grand. ASIAN WOMAN: What's your point? MARTIN: Maybe you arranged to have his wallet lightened for him. ASIAN WOMAN: Get real! I'm working on a graduate degree in women's studies from Rutgers. You really want to find out what happened to this guy, why don't you ask one of his army buddies? DANNY: What are you talking about? ASIAN WOMAN: Bull contacted me again that night, around 1:30. (Quick flashback to: JOHN CARVER sits in the telephone booth speaking on the phone.) JOHN "BULL" CARVER: It's a tough transition, you know. It's my first night of civilian life. (Someone knocks on the telephone booth door.) Hold on. MANNY AYBAR: Hey, I've been looking for you, Bull. Everything all right? JOHN "BULL" CARVER: (to AYBAR) Yeah, I'm fine, I'm fine. Just finishing up here. Give me a minute, okay? (End of flashback. Resume to present.) ASIAN WOMAN: I said I could be free, if he could wait a couple of hours. DANNY: And that's when you agreed to meet him in his hotel room, right? ASIAN WOMAN: That's right. Except I got there a little early, and there was somebody else there. MARTIN: Who? ASIAN WOMAN: I met him earlier at the card tables. A little man with a beard. Sykes, I think his name is. CUT TO: WHITEBOARD TIMELINE: 4:15 A.M. - SYKES IN BULL'S ROOM [EXT. SYKES' RESIDENCE - DAY] LEGEND: MADISON, SOUTH CAROLINA (A Police Car pulls up to the house.) SCENE #11: [EXT. / INT. SYKES' RESIDENCE -- DAY] (SAMANTHA gets out of the police car. She and the OFFICER make their way to the front door.) SAMANTHA: Remote spot. OFFICER: Oh, Wally likes it that way. Given what a place like this does for property value, most of the townspeople prefer it that way, too. That's his car. He should be home. Mr. Sykes? You home? (He knocks on the door.) Mr. Sykes, open up. State police. (WALLACE SYKES opens the front door.) SAMANTHA: Mr. Sykes? Special Agent Spade, FBI. OFFICER: We come in a sec, Wally? (WALLACE SYKES holds the door open. The OFFICER walks in.) SAMANTHA: After you. OFFICER: Whoo-ooh! Cleaning lady's day off, huh? WALLACE SYKES: Excuse the mess. I wasn't expecting company. SAMANTHA: Mr. Sykes, I need to ask you some questions about Lieutenant Colonel John Carver. WALLACE SYKES: What about him? SAMANTHA: He disappeared sometime afternoon Sunday. No one's seen or heard from him since. I was wondering if you could give us your account of the weekend -- anything you may remember. OFFICER: Won't take long. We'll take you to the station. Take a statement. We'll drive you back. WALLACE SYKES: Sure, okay, uh ... just let me, uh, put my boots on. (WALLACE SYKES exits the room.) OFFICER: Place could use a woman's touch, huh? (SAMANTHA looks around. She picks up a photograph of his old platoon.) (A gunshot is heard coming from the next room. SAMANTHA looks up and sees blood spatter onto the window.) (She and the officer draw their weapons and enter the room. WALLACE SYKES is on the floor, his gun near his head. The officer kneels down to check for a pulse.) SAMANTHA: Oh, my god. FADE TO BLACK. (COMMERCIAL SET) SCENE #12: [INT. SYKES' RESIDENCE -- DAY] (SAMANTHA looks around the room as they wheel out the body on a gurney. There's drug paraphernalia all over the room.) SAMANTHA: Your friend Wally went on a hell of a bender. I found drug paraphernalia in his bedside table. OFFICER: So, what do you think? He and that guy from Atlantic City had some kind of suicide pact? SAMANTHA: I think that whatever went down in Atlantic City, he would have rather killed himself than faced the music. (SAMANTHA looks at the blood on the window.) SAMANTHA: (softly) God! OFFICER: Way it looks, Sykes has been killing himself for a long time. SAMANTHA: Yeah. (They leave the room.) CUT TO: SCENE #13: [INT. HOTEL - BALLROOM -- DAY] (DANNY interviews MANNY AYBAR.) MANNY AYBAR: This whole thing about Sykes ... I-I just can't believe it. DANNY: Well, Sykes was seen leaving Bull's hotel room about 4:15 in the morning on Sunday. We think Sykes staged it to make it look like Bull took his own life. MANNY AYBAR: I guess it's possible. Bull used to ride Sykesie pretty hard. DANNY: According to witnesses at the bar, Bull spent the whole night defending Sykes against Plesac. MANNY AYBAR: I don't know what to tell you. DANNY: Tensions were running pretty high, don't you think? MANNY AYBAR: None of us had seen each other for thirty years. For Sykes to kill Bull over something so long ago, he must have been crazy. CUT TO: SCENE #14: [INT. SYKES' RESIDENCE -- DAY] (SAMANTHA goes through WALLACE SYKES' things on his dresser and finds a medal in a tray of knick knacks.) CUT TO: SCENE #15: [INT. FBI - MISSING PERSONS UNIT -- DAY] (SAMANTHA is on speaker phone with JACK, VIVIAN and MARTIN.) SAMANTHA: (on phone) He stole one of Carver's service medals. I just found it on his dresser. MARTIN: So Sykes kills Bull, takes his room key, slips into Bull's hotel room, and tries to make it look like a suicide. JACK: Yeah, but remember what the hooker said. When she knocked on the door, Sykes answered. Which he would only have done if he thought it was his accomplice. VIVIAN: Are we sure that it's Bull's medal? INTERCUT WITH: SAMANTHA: Oh, yeah. It says it right here. (reading) "Lieutenant John Carver, for valorous conduct at Kam Li." JACK: What's the significance of Kam Li? VIVIAN: That's where sergeant Thomas Lewis was killed. I think I got a bit more on it here ... (rifles through the files and finds it) Bull, Plesac, Sykes, Aybar and Congressman Whitehurst, they were all there. JACK: Okay, I want you to contact the department of defense. Get everything you can on Kam Li. Martin, grab your coat. We're going to Washington. (JACK stands up. MARTIN nods.) CUT TO: [EXT. WASHINGTON (STOCK) - NIGHT] SCENE #16: [INT. CONGRESSMAN WHITEHURST'S OFFICE -- NIGHT] LEGEND: 41 HOURS MISSING (JACK and MARTIN sit in the waiting room. JACK looks up at the ceiling. It's apparent that they've been there a while. MARTIN reads a magazine.) JACK: Ma'am, we've been waiting for the Congressman for over an hour. (SUSAN, is on the phone.) JACK: You got a bathroom? SUSAN: Yes, sir. Down the hall. JACK: Mind if I use it? (JACK stands up and heads for the hall. He sees someone familiar.) VICTOR FITZGERALD: Hey, there, Jack. JACK: Hey, there, Victor. What brings you to this branch of the government? (MARTIN sighs.) VICTOR FITZGERALD: Hey, Sue. Thought I might ask you the same thing. (MARTIN stands up to join them.) JACK: Why do I have the feeling you already know? VICTOR FITZGERALD: I'm just here to make sure everything goes smoothly. Martin! MARTIN: Hey, dad. (The two shake hands.) VICTOR FITZGERALD: (to JACK) So, how's my boy doing? They giving him a hard time because of his old man? JACK: Well, I don't know. Are we? MARTIN: Constantly. JACK: Yeah. (VICTOR FITZGERALD chuckles. The office door opens and CONGRESSMAN WHITEHURST walks out.) VICTOR FITZGERALD: Congressman Whitehurst. CONGRESSMAN WHITEHURST: Mr. Deputy Director. (They shake hands.) VICTOR FITZGERALD: Now, do you know my colleague? This is Special Agent Malone from New York. JACK: Congressman ... CONGRESSMAN WHITEHURST: How are you? (They shake hands.) VICTOR FITZGERALD: And of course, this young man is my son, Martin Fitzgerald. CONGRESSMAN WHITEHURST: Ah, I see the apple doesn't fall far from the tree. (The CONGRESSMAN escorts the DEPUTY DIRECTOR into his office. MARTIN throws JACK a glance before following.) CUT TO: SCENE #17: [INT. WHITEHURSTS'S OFFICE - NIGHT -- CONTINUOUS] (JACK questions CONGRESSMAN WHITEHURST.) CONGRESSMAN WHITEHURST: You know, it's so hard to process. The fact that I saw these men as recently as Saturday night. JACK: How was Wallace Sykes? CONGRESSMAN WHITEHURST: Now that I think about it, a little on edge. I knew that he had problems with substance abuse -- alcohol. JACK: What about Bull? What were his problems? CONGRESSMAN WHITEHURST: I don't know; he and I lost touch over the years. JACK: Any idea why he was retiring? CONGRESSMAN WHITEHURST: No. I assumed it was because of his age. JACK: We found this medal in Sykes' bedroom. (JACK rises and hands the CONGRESSMAN the medal.) JACK: We believe he took it from Bull's hotel room Sunday morning. CONGRESSMAN WHITEHURST: (reading) "Kam Li." I haven't thought about Kam Li for a long time. JACK: You want to talk about it now? CONGRESSMAN WHITEHURST: I don't know everything, but I can tell you my part in it. We'd received reports that a VC commander was using the village as a staging area. Bull Carver led the recon team, while the rest of us waited at a rally point across the river. We heard gunfire from the village. (Quick flashback to: The team returns from their trek to the village.) WHITEHURST: (v.o.) I had no idea what had gone down until Bull and the team came back. (WHITEHURST puts down his binoculars.) WHITEHURST: Bull! There's the Captain. MAN: Ten more coming in! WHITEHURST: What the hell happened up there, Aybar? AYBAR: Beaucoup bad, Cap. WHITEHURST: Bull, what'd you find? CARVER: They got Tommy. WHITEHURST: What? CARVER: Snipers, Cap. WHITEHURST: Everything was quiet. CARVER: (panting) Walked right into an ambush! WHITEHURST: How many were there? CARVER: Don't freeze on us, Cappie! You got to make the hard choices. We cleared the people out. We got to blow up that weapons cache. WHITEHURST: Davis? DAVIS: Yes, Captain Whitehurst. WHITEHURST: Get command on the horn. All right, let's do this. (Cut to: A flare is sent up in the sky.) (End of flashback. Resume to present.) WHITEHURST: The village was evacuated, and, uh ... I called in the air strike. (WHITEHURST returns the medal to JACK.) VICTOR FITZGERALD: Based on information that Bull Carver had provided. WHITEHURST: Correct. JACK: Did you go back to the village after the air strike? WHITEHURST: Of course. We couldn't just leave Tommy's body there. JACK: Did you see any of the weapons that Bull had talked about? WHITEHURST: No, they had exploded during the bombing. Tommy Lewis was dead. Bull and Sykes said they saw a cache of weapons. I had no reason not to take them at their word. JACK: Do you now? WHITEHURST: Nothing's changed between now and then. JACK: No, nothing, except the fact that one man is missing and another is dead. (The CONGRESSMAN sits back in his seat. He looks over at VICTOR FITZGERALD.) VICTOR FITZGERALD: You know what, Congressman? I think we've taken enough of your time for today. Thank you. (VICTOR FITZGERALD stands up. The interview is finished. He walks out of the room. JACK stands up and follows.) CUT TO: SCENE #18: [INT. OUTSIDE CONGRESSMAN WHITEHURST'S OFFICE - NIGHT -- CONTINUOUS] (VICTOR FITZGERALD walks out of the office, JACK and MARTIN exit the office. MARTIN closes the door behind him.) VICTOR FITZGERALD: What the hell was that? JACK: An interview. VICTOR FITZGERALD: No, that was an interrogation, and a hostile one, at that. JACK: He's hiding something, and we both know it. VICTOR FITZGERALD: And that's based on what? 'Cause I found him very forthcoming. JACK: It's based on my instinct. VICTOR FITZGERALD: You better have something more than "instinct". You better have hard evidence. And if you plan on interviewing him again, you let me know. (VICTOR FITZGERALD walks out of the room.) JACK: Didn't even wait for me to say, "yes, sir." MARTIN: He never does. CUT TO: SCENE #19: [INT. FBI - MISSING PERSONS UNIT -- DAY] (VIVIAN is finishing up a phone call. SAMANTHA stands near her.) VIVIAN: (to phone) Thanks. You, too. (VIVIAN hangs up.) SAMANTHA: You got something? VIVIAN: Turns out, we're not the only ones looking into Kam Li. About a month ago, the Department of Defense received a request under the freedom of information act. Guess who filed it? SAMANTHA: New York Times? VIVIAN: Thomas Lewis. SAMANTHA: What?! Thomas Lewis, as in the Thomas Lewis who was killed by snipers at Kam Li? VIVIAN: Thomas Lewis Jr., his son. CUT TO: SCENE #20: [INT. FBI - MISSING PERSONS UNIT - CONFERENCE ROOM -- DAY] (SAMANTHA and VIVIAN interview THOMAS LEWIS, JR.) THOMAS LEWIS, JR.: I got a letter two months ago. It was unsigned, but it was obviously someone who had served with my father. He said that my father didn't die the way the army reported it -- that there was a cover-up, to protect one of their own. VIVIAN: Anything else? THOMAS LEWIS, JR.: That he loved my father, wanted to honor his memory, and wanted me to know what a hero he was. VIVIAN: Were Bull and your father very close? THOMAS LEWIS, JR.: After my father died, Bull was like a surrogate father to me. He was always sending us money, souvenirs from all around the world. SAMANTHA: Do you think Bull's the one who sent the letter? THOMAS LEWIS, JR.: I've certainly suspected as much. VIVIAN: Do you have the letter with you? THOMAS LEWIS, JR.: Uh, yes. (He pulls out a file and hands it to VIVIAN.) It's a copy. I have the original at home. VIVIAN: We're going to have to have that, as well. (VIVIAN opens the file and glances at the letter.) Has anyone else seen this? THOMAS LEWIS, JR.: Just my wife and the Congressman. SAMANTHA: Congressman Whitehurst? THOMAS LEWIS, JR.: I contacted his office. He said he'd look into it for me. (Camera holds on SAMANTHA.) FADE TO BLACK. (COMMERCIAL SET) FADE IN. [EXT. WASHINGTON (STOCK) - DAY] LEGEND: 55 HOURS MISSING SCENE #21: [INT. CONGRESSMAN WHITEHURST'S OFFICE -- DAY] (JACK and MARTIN sit in the waiting room trying to catch the Congressman. JACK looks at his watch.) MARTIN: (doesn't look up) Sure you don't want to wait for my father? JACK: I left word at his office. MARTIN: It's a shame we missed him. CONGRESSMAN WHITEHURST: Morning, Susan. (The CONGRESSMAN walks in. He turns and notices JACK and MARTIN sitting in his waiting room.) CONGRESSMAN WHITEHURST: Gentlemen. You camped out here all night? JACK: I have a few more questions I need to ask you. CONGRESSMAN WHITEHURST: You've got ten minutes. (The CONGRESSMAN walks into his office. JACK and MARTIN get up and follow him.) CUT TO: SCENE #22: [INT. CONGRESSMAN WHITEHURST'S OFFICE - DAY -- CONTINUOUS] (JACK and MARTIN question CONGRESSMAN WHITEHURST.) CONGRESSMAN WHITEHURST: I may have seen a copy of this. I'm not certain. JACK: A letter about an incident you were directly involved in and you don't remember? CONGRESSMAN WHITEHURST: Charges are vague and unsubstantiated. I don't trust unsigned letters. I serve on the intelligence subcommittee. I see way too many of them. JACK: Assuming the letter is true, what do you think it's alluding to? CONGRESSMAN WHITEHURST: I couldn't even speculate, nor would I. JACK: Then allow me to. I believe this was a case of friendly fire. There was no evidence of weapons in that village, and you called in the air strike. CONGRESSMAN WHITEHURST: I already told you: I called in the air strike based on what my men reported to me. JACK: As I told you, one of those men is dead and the other one is missing. I believe the missing man wrote this letter. CONGRESSMAN WHITEHURST: What are you accusing me of? JACK: Nothing. I'm asking you questions, and I'm not getting any answers. CONGRESSMAN WHITEHURST: I think your ten minutes are up. (WHITEHURST stands up. JACK looks over at MARTIN. They both stand up to leave.) CUT TO: SCENE #23: [INT. HOTEL -- DAY] (DANNY continues to go through the security video tapes. An AGENT walks up to him.) AGENT: Agent. DANNY: What? AGENT: We found his service pistol. DANNY: Where? AGENT: Near the pier, just off the beach from Bally's. Surfcasters called it in. DANNY: Thanks. CUT TO: SCENE #24: [INT. FBI - MISSING PERSONS UNIT -- DAY] (SAMANTHA grabs some colored yarn off of the table. VIVIAN walks in.) VIVIAN: What are you doing? (SAMANTHA turns around and shows VIVIAN the clear map that she's been working on.) SAMANTHA: Well, it's all about Verizon, Sprint and AT & T. Okay, have a look. Orange for Plesac, blue for Aybar, yellow for Sykes. VIVIAN: No Whitehurst? SAMANTHA: No, his records seem to be a little bit harder to come by. There were a lot of phone calls between them before the reunion. I'm just trying to figure out if there's some kind of a pattern to it. (VIVIAN looks a the map and smiles.) VIVIAN: I like all the colors. (She walks away. SAMANTHA smiles at the remark.) CUT TO: SCENE #25: [INT. FBI - HALLWAY / JACK'S OFFICE -- DAY] (The elevator doors open. JACK and MARTIN walk out.) DANNY: How was Washington? (MARTIN doesn't say anything. He heads for his desk in the main office. JACK walks into his office. DANNY, carrying a file, follows him.) JACK: "D.C.," As in "Didn't Cooperate." I did get a free pen out of Whitehurst's office, though. DANNY: Jack, want to take a look at this? JACK: Sure. (JACK sits in his chair and looks at the photo.) DANNY: These are the location photos of where the local cops found Bull's service pistol. JACK: It's a Russian Tokarov. DANNY: Yeah. Jack knows his guns. JACK: Yeah, my father had one. Spoils of war. They used to confiscate them from the vietcong. (VIVIAN walks into the office.) VIVIAN: You got a minute? DANNY: He definitely does, because I have to run. Thanks, Jack. (DANNY takes his files and walks out of the office.) VIVIAN: Fitzgerald looks like he's twisting in the wind. JACK: His old man's a giant pain in the ass. VIVIAN: Okay. JACK: What'd you get from the Department of Defense? VIVIAN: Nothing yet on why Bull was booted out, but I do have something on Sykes. The day that anonymous letter was sent to Thomas Lewis Jr., Sykes was in the VA hospital in the Bronx. Same postmark with the same zip code. And his prints were all over the original letter. JACK: Let's bring in Aybar and Plesac. VIVIAN: Okay. CUT TO: SCENE #26: [INT. FBI - CONFERENCE ROOM -- DAY] (JACK interviews MANNY AYBAR who is looking at the anonymous letter sent to TOMMY LEWIS, JR.) MANNY AYBAR: Are you saying Sykes sent this to Tommy's son? JACK: You've never seen this letter? MANNY AYBAR: Hell, no. JACK: Any possibility that it's true? MANNY AYBAR: Only two people in the world can tell you for sure and that's Sykes and Bull. JACK: You want to tell me about Kam Li? CUT TO: SCENE #27: [INT. FBI - CONFERENCE ROOM -- DAY] (VIVIAN interviews PLESAC.) PLESAC: I was part of the advance unit. Bull sent us. Had us move all the villagers out onto the road, so we could conduct a thorough search. VIVIAN: What did you uncover? PLESAC: Nothing ... at first. (Quick flashback to: Back in Vietnam, the men round up the villagers.) ASIAN MAN: (yelling) Liar! Liar! (TOMMY LEWIS comes out into the clearning.) TOMMY LEWIS: Come on, Bull, let's pull out. Nothing here. Let's pull out. CARVER: Lewis, get back and finish your job! Get out of here, Tommy. I mean it. ASIAN WOMAN: (screaming) We know nothing! Nothing! (TOMMY LEWIS turns around and heads back to the village.) (End of flashback. Resume to present.) PLESAC: He sent him back in to keep looking. VIVIAN: What did he expect to find? PLESAC: Weapons ... evidence they were stockpiling ... see, that was the trouble with that damn country. Everyone you met was a potential enemy. (Quick flashback to: The soldiers not searching the village watch over the villagers.) ASIAN WOMAN: (to CARVER) We know nothing! We know nothing! CARVER: We know you've got guns! We know that! ASIAN MAN: You die! You die! You die! You die! CARVER: You're coming with me. (CARVER grabs the girl around the waist and starts dragging her into the forest.) CARVER: Keep them here! (The MAN with The WOMAN starts yelling in vietnamese ) CARVER: Got it! (CARVER carries the WOMAN kicking and screaming into the forest.) AYBAR: Stay down! (End of flashback. Resume to present.) CUT TO: SCENE #28: [INT. FBI - CONFERENCE ROOM - DAY] MANNY AYBAR: Bull was convinced the girl was a VC sympathizer and that she could show us where the weapons were. Sykes confirmed seeing the weapons stockpile. JACK: But from what you just told me, Sykes was standing watch on the road. MANNY AYBAR: He was, until Tommy came back. (Quick flashback to: TOMMY LEWIS returns back to the group.) TOMMY LEWIS: Sykes, where's Bull? WALLACE SYKES: Not here. TOMMY LEWIS: What do you mean he's not here, man? Where'd he go? WALLACE SYKES: Bull wanted us to stay put. TOMMY LEWIS: These people ain't VC, just a bunch of damn peasants. Take me to him! WALLACE SYKES: Can't do that. TOMMY LEWIS: I'm your superior officer, and I'm ordering you, private. Show me where he went. Show me where he went! (TOMMY LEWIS grabs WALLACE SYKES and pushes him to the forest. They leave together.) (End of flashback. Resume to present.) MANNY AYBAR: And that was it. That was the last time I saw Tommy alive. JACK: And how long were they gone? MANNY AYBAR: Couple of minutes, maybe. Then we heard gunshots. The girl had walked him into an ambush, and they got Tommy. JACK: Did you or anybody else see these weapons that Bull and Sykes said they found? MANNY AYBAR: Sykes saw them. He backed it up. And Sykes' word ... that's good enough for me CUT TO: SCENE #29: [INT. FBI - CONFERENCE ROOM - DAY -- CONTINUOUS] PLESAC: We reported back to Whitehurst. Told him what happened. He called the air strike. That was over in five minutes. The whole jungle shook from that bombing. They wanted us to wait till the next morning to reenter the village, but we went back in. VIVIAN: To get sergeant Lewis' body from under the rubble? PLESAC: You got to understand how we felt about Tommy Lewis. He was the finest individual I've ever known. (voice breaking) It was only right and fitting that we should ... at least get his body and send it home so he could have a decent burial. (VIVIAN looks at PLESAC.) CUT TO: SCENE #30: [INT. FBI - JACK'S OFFICE -- DAY] (JACK meets with VIVIAN.) JACK: I just don't buy it. I think they're covering up for Whitehurst. I think that, somehow, Lewis was left behind in the village and he was killed by friendly fire. When they went back there, they didn't find the weapons, they just found rubble, so Whitehurst makes up this story about some kind of ambush. Lewis becomes a martyr, and they all walk out of there with medals. VIVIAN: And now he's in Congress. That makes sense. (MARTIN walks in.) MARTIN: Hey, I just checked with the army to see if they had a copy of Tommy Lewis' autopsy report. They never did one, but his widow did, way back in '71. According to the report, Lewis died from a single gunshot wound to the head. VIVIAN: What was the weapon? MARTIN: Russian Tokarov. VIVIAN: That's Bull's gun. VIVIAN: Forensics on his gun match the bullet found at your father's autopsy. TOMMY LEWIS, JR.: You're sure? JACK: You never suspected that? TOMMY LEWIS, JR.: How do you explain the way Bull was to me all those years? JACK: I don't know. Guilt. TOMMY LEWIS, JR.: Yeah, he's so guilty he sends me that letter? VIVIAN: That was Wallace Sykes. TOMMY LEWIS, JR.: Sykes? JACK: Where were you the night of the retirement dinner? TOMMY LEWIS, JR.: Hey, if I knew what you're telling me now, maybe I would have killed him. But I didn't know. And I was nowhere near Atlantic City. VIVIAN: Will you take a polygraph? TOMMY LEWIS, JR.: Let's go. CUT TO: SCENE #32: [INT. FBI - MISSING PERSONS UNIT -- DAY] (SAMANTHA goes over her telephone map findings with MARTIN.) SAMANTHA: Okay, let's start here. First phone call on the third of last month. Manny Aybar in Michigan calls Wallace Sykes in South Carolina. MARTIN: Wondering why Sykes hasn't RSVP'd for the retirement dinner. SAMANTHA: Okay, but according to Ma Bell, they talk on the phone for over three and a half hours. Two men who, by Aybar's own account, are not particularly close and haven't spoken since the war. MARTIN: A lot of catching up to do. SAMANTHA: No, see, I think this is when Sykes first confesses that he lied about seeing weapons at Kam Li, because look: Aybar, on that Friday, gets on a plane and flies to South Carolina. He just drops everything and flies halfway across the country? For what? To hang out at Sykes' hellhole of a cabin? I don't think so. He's got to be talking about Lewis' murder, because the minute Aybar gets back to Michigan that Sunday, five phone calls in 24 hours. Trust me, they're talking about more than the buffet menu. And they conveniently manage to leave Lewis Jr. out of the loop. MARTIN: Then you got Plesac calling Sykes. SAMANTHA: To confirm what Aybar was telling him, and to try and figure out what Sykes is going to do with it. MARTIN: Can you tie Whitehurst to any of this? SAMANTHA: Not directly. But the following Wednesday, Aybar makes another call ... to the congressional switchboard in Washington, DC. CUT TO: SCENE #33: [INT. FBI - JACK'S OFFICE -- DAY] (MARTIN and SAMANTHA take their findings to JACK.) MARTIN: Whitehurst is the one with the most to lose and they'll do everything they can to protect him. SAMANTHA: That's why he leaves the dinner before any of this went down They were all in on it: Sykes, Aybar, Plesac ... MARTIN: ... and Whitehurst. SAMANTHA: Yep. (VIVIAN walks into the office with a file.) VIVIAN: I got this from the Department of Defense. Bull Carver was accused of sexual assault in the Philippines last year. Charges were never filed. The parents hushed it up, because the girl was underage. Bull agreed to pay full restitution to the family, but the army had had enough and they forced him out because, apparently, this was not the first time. MARTIN: We know he had a thing for Asian girls. (JACK thinks about it for a moment.) (Quick flashback to the WOMAN in the village. End of flashback. Resume to present.) JACK: The key to this is the girl at Kam Li. (Quick flashback to: JOHN "BULL" CARVER grabs the girl around her waist and drags her kicking and screaming into the forest.) JACK: (v.o.) Bull took her to the village to rape her. Lewis went after him, they argued, Bull shot him - (End of flashback. Resume to present.) JACK: ... and that's what Sykes has been hiding all these years. VIVIAN: What happened in Atlantic City? MARTIN: And how are we going to prove it? CUT TO: [EXT. NEW YORK CITY (STOCK) - LATE DAY] SCENE #34: [INT. FBI - MISSING PERSONS UNIT -- DAY] (DANNY shows MARTIN something in a file. MARTIN looks up and sees his father walk rapidly in the hallway toward JACK'S office.) MARTIN: Oh, great. DANNY: What? MARTIN: Hold on to your hat. (MARTIN walks away from DANNY.) CUT TO: SCENE #35: [INT. FBI - JACK'S OFFICE - DAY -- CONTINUOUS] (VICTOR FITZGERALD walks into JACK'S OFFICE angry. He puts a file on JACK'S desk.) VICTOR FITZGERALD: You want to explain this? JACK: It explains itself. I need you to authorize a polygraph. VICTOR FITZGERALD: For Congressman Whitehurst? Are you out of your mind? JACK: You came all the way from Washington to tell me that? VICTOR FITZGERALD: I came all the way from Washington because you've got a bug up your ass with this guy. JACK: This is a conspiracy. These guys are stonewalling, and Whitehurst is at the center of it. VICTOR FITZGERALD: Based on what, a series of phone calls? The man left the hotel at 10:30. JACK: Just because he didn't participate in the murder doesn't mean he's not involved. VICTOR FITZGERALD: The answer's no. JACK: I'm not covering this up. VICTOR FITZGERALD: I'm not asking you to. No polygraph. You want Whitehurst, find another way. (VICTOR leaves the office.) CUT TO: SCENE #36: [INT. FBI - MISSING PERSONS UNIT - DAY -- CONTINUOUS] (VICTOR FITZGERALD meets up with someone he knows. MARTIN looks up from his file and sees his father. He closes the file and heads for him.) VICTOR FITZGERALD: Hey, Lee. Good to see you. I heard they moved you to New York. Bet you miss Colorado though, huh? You take care. (The man leaves. MARTIN reaches his father.) MARTIN: You heading right back? VICTOR FITZGERALD: No, I've got some business upstairs. MARTIN: Well, look ... before you go, I'd like a chance to weigh in here. VICTOR FITZGERALD: Look, Martin, first you come down to interrogate a United States Congressman and you don't even have the courtesy to check in with the DC office, and then ... then you go back a second time, against my direct order. You can't expect me to be okay with that. MARTIN: You know, I think a lot of this has to do with personalities right now. VICTOR FITZGERALD: Meaning what? MARTIN: Meaning Jack didn't take some wild flier here. We're following up on a legitimate lead. VICTOR FITZGERALD: Well, why do you think he brought you to Washington in the first place? It was to run interference with me. MARTIN: No, I don't buy that for a second. VICTOR FITZGERALD: Jack Malone is a very talented agent, and I understand why you respect him, but he's a free swinger. Now, sometimes free swingers hit it out of the park. But a lot of the time they miss the ball completely. MARTIN: So what are you telling me? VICTOR FITZGERALD: Let's just say Jack has made some mistakes lately, and it hasn't gone unnoticed. I just want you to have my perspective on it. And I want you to be careful, Martin. I'll tell your mother that you're looking well. (MARTIN doesn't say anything. VICTOR FITZGERALD walks away.) CUT TO: SCENE #37: [INT. FBI - INTERROGATION ROOM -- DAY] (JACK talks with MANNY AYBAR.) JACK: You know, we've pieced together this whole thing. The phone calls ... the weekend you spent with Sykes. I believe that you the catalyst for all of this. Now, this is going to come out sooner or later. It can happen in here, or it can happen in front of a grand jury. Believe me, I understand this. I understand military justice. MANNY AYBAR: What the hell do you understand? JACK: I was in the 82nd airborne, first battalion in the 504 in '79. MANNY AYBAR: Red devils, huh? JACK: Yeah. Baggy pants. MANNY AYBAR: Where'd you do basic? JACK: Benning. MANNY AYBAR: Hot as hell down there. So what happened? How'd you end up here? JACK: Busted up my leg in a PLF training mission. Desk job just wasn't an option. There was a lot of things that I didn't like about the army, but the one thing that I respected ... was that you knew that the guy next you would kill or die for you. I believe Bull broke that trust. I understand why you had to do what you did, and I understand why you had to do it together. Now, you got to help me. I don't want this to go public, but I cannot let it slide. MANNY AYBAR: Okay. Okay. It was me and Sykes. The others weren't involved. JACK: Tell me exactly how it went down. MANNY AYBAR: Tommy ... Tommy was like a brother to me. And when he didn't come back from Kam Li, I got this - this feeling in the pit of my stomach that something wasn't right. But Sykes swore by Bull. He idolized Bull. JACK: Did Sykes actually see Bull kill Tommy? MANNY AYBAR: No, it wasn't until Bull lied about the weapons cache that Sykes realized what had happened. CARVER: Where's that scotch you were talking about? MANNY AYBAR: No more alcohol, Bull. You're going to want to be sober for this. CARVER: What's going on? You guys act like this is some kind of funeral, or something. WALLACE SYKES: Don't turn your back on me, you son of a bitch! (He turns around to look at him.) WALLACE SYKES: I want to hear you say it. CARVER: Say it? Say it? Say what? (JOHN "BULL" CARVER falls back onto the bed.) WALLACE SYKES: You killed Tommy and I covered for you. I'm not covering for you anymore. (CARVER gets off of the bed and stands in front of SYKES.) CARVER: Oh ... all of a sudden, Sykes, you grew a pair. (AYBAR slowly removes his jacket.) All of a sudden, you're the hero now. You knew all those years ... you accepted that medal they hung on your chest. (CARVER turns around to look at AYBAR.) I think you've taken the bullet for Plesac and Whitehurst. MANNY AYBAR: (unwavering) That's what happened. (There's a soft knock at the door. It opens and VIVIAN motions to JACK to step outside.) CUT TO: SCENE #38: [INT. FBI - HALLWAY /OBSERVATION ROOM - DAY -- CONTINUOUS] (VIVIAN fills JACK in on the latest.) VIVIAN: Bull's daughter came in. She got a package from him, sent from Atlantic City before the retirement dinner. It's his last will and testamant and a suicide note. (VIVIAN hands JACK the papers.) JACK: Is it his handwriting? VIVIAN: She says it is. (VIVIAN looks at MANNY AYBAR through the observation window.) What did he tell you? JACK: Name, rank and serial number. (JACK looks up at MANNY AYBAR.) (Quick flashback to: JOHN "BULL" CARVER looks at himself in the mirror just before the Retirement Dinner. End of flashback. Resume to present.) JACK: It's a suicide. CUT TO: SCENE #39: [EXT. WALLACE SYKES' RESIDENCE -- DAY] (SAMANTHA kneels down and watches as they remove the body from the ground and place him in a body bag.) TV REPORTER (WOMAN): (v.o.) Police have been searching the area since Mr. Sykes' suicide. The body of Lieutenant Colonel John Carver was found in a gravel quarry near the town of Asheville, South Carolina, where it had apparently had been transported in the trunk of Mr. Sykes' car sometime during the early morning hours. CUT TO: SCENE #40: [INT. CONGRESSMAN WHITEHURST'S OFFICE -- DAY] (Camera opens on the medals in a frame hanging on the wall in CONGRESSMAN WHITEHURST'S Office.) TV REPORTER 2 (MAN): (v.o.) There are still more questions than answers here, but authorities maintain that it was a suicide pact between the two old soldiers. (The camera pans down to show the CONGRESSMAN working behind his desk with his Assistant nearby.) TV REPORTER 3 (WOMAN): (v.o.) Lieutenant Colonel Carver a two-time winner of the Silver Star will be buried by his daughter in a private ceremony CUT TO: SCENE #41: [INT. FBI - MISSING PERSONS UNIT - HALLWAY -- NIGHT] (JACK walks down the hallway toward the elevator. MARTIN walks to catch up with JACK.) MARTIN: Jack. JACK: Yeah. MARTIN: You got a second? I, uh ... I heard that you're catching a little hell for the way this Whitehurst thing was handled. JACK: Yeah, it's a little messy right now, but, uh, it'll blow over. Right. MARTIN: Well, for what it's worth, if anything does go down, I thought it was handled just fine. (MARTIN turns and walks away.) JACK: (quietly) Thank you. (JACK walks into the elevator.
